Throttle Actuator Warranty for Oregon?

My 2011 E90 has started to generate codes for bad throttle actuator and sometimes it goes into limp mode. I had read that some people have been able to get this covered under the emissions warranty, but I believe it depends on the state. I think Oregon might be under the 7/70 or 8/80 length of warranty for emissions, but I wasn't sure. If it was, my car would still be covered due to its current age and mileage.

I wasn't sure if it made sense for me to go to the dealer since they want to charge my $160 to diagnose it before they will tell me anything about if its covered by any warranty.

Does anyone have any idea regarding Oregon emissions warranty or if a throttle actuator would be covered? Thanks in advance for any guidance.

Yes, Oregon is covered by the California Emissions Warranty, and yes the TAs are covered under said warranty. See attached manual, page 36 & 39.

From the 2011 M3 Manual:

California Emission Warranty Parts List
The following components are covered for defects by the California Emission Control System Limited

Warranty for a period of 7 years or 70,000 miles, whichever comes first:

Throttle Actuator

Let us know if you were successful in getting the dealer to replace it under warranty. Good luck.
