i'm all for it, and i know that it's perfectly legal to do so nearly everywhere, but i don't know if i would be giving away a gun to some random person from the internets. i guess it's no different than winning one from a store, just much bigger contestant pool.

Im sure the winner will be background checked and you have to send the gun to a "store" first.

ahh didn't think of it that way. here, you can literally hand anyone a gun as a gift with no background check or anything, as long as they're legal age to own a gun. this isn't to say i would hand a gun to a known felon, but one could easily just do an in person exchange with little to no paperwork.

Not sure if you can do that legally, but chances of you being caught are impossible (until something goes wrong).

Legally, I think you have to transfer ownership through a FFL, a Federal Firearms Licensed dealer. The ATF keeps tabs on them regularly and can audit their records.

If you give someone a gun as a gift and they shoot up a store and ditch the gun in a sewer, when they find it they are coming for you and not the guy who did it.

Post what is right then... smartass.

I never said I was right, but I would think me walking down the street with my glock and handing it to someone for free isn't exactly legal.

It varies by state, in FL if you wanted you could give your gun to anyone, so long as you have no reason to believe they were a felon or otherwise not legal to own it. No papework, nothing.

However that is between two private parties.

A business must go through the paperwork and BCs to transfer a weapon, and I believe anytime the transfer is over state lines it must go through FFL.

Quoted for truth. In Indiana, the private party transaction procedure is very similar, if not identical to, the Florida procedure mentioned by O-cha.

However, if I buy a gun at a local gun shop, paperwork and background check = required. If I buy a gun online at Buds or at Gunbroker, the gun must be shipped to an FFL, and again, paperwork and background check = required.

it is entirely legal...in fact, many people only do private transactions to avoid any FFL registration....the are legal to own guns, they just don't want anyone knowing what they got...

This is the "gun show" exception that has all of the gun grabbers up in arms...especially Bloomberg...

Yea, I figured it varied by state, but just wasn't sure. Thanks for the info though, appreciate it!

Nothing like having to put down some serious cash to be entitled to your Second Amendment rights.

Doesn't the Uniform Firearms Act also provide for immediate family transfers? E.g., I gifted a pistol to my father. Later he gifted it to my brother. I could not directly gift it to my brother, but the family caveat allows the parent-child exception. Otherwise, all handgun transfers have to go through an FFL as I understand it. Longarms.. have at it. But, handguns have a different circumstance. I'm also not sure if the duty is on the seller or the buyer to prove ability to own (not a felon, 18, etc.)

What's wrong with .40s&w? Yeah, it's not the FBI's 'dream round' it was supposed to be (10mm), but it's still an excellent round. Premium JHPs for intended for self defense have proven to penetrate and expand well out of my 4" bbls such as an XD40 or G23. Not trying to start a 9mm v .45 debate, but it's shot placement that counts.

$340 Permit just to own or to carry? How do the laws work in NY? Not everyone can get a CCL and your guns need to be registered or what?

In the dirty south (Florida in my case)... I paid $140 for a 2 hr concealed weapon course and then sent off a $75 application fee to the state. Received my license back in 6 days to carry concealed. Simply to own a gun or buy a gun there is absolutely no permits or registrations of any sort if you are not a felon.
