Some people have asked me if I have anything to update, and as of 9:12 AM today (April 3, 2008) I dont have much.

Mr. Maledon advised the car will arrive @ South Bay BMW on April 9, 2008, though it looks as if the transport company has not picked the car up yet. I know that the title has been received by the leasing company. I hope they pick the car up today, as my lease has already started.

Been hearing about this thread all over and I'm not about to read 100+ Pages to find out whats the verdict so I'll just ask. Is it my understanding from reading the above post that after winning the car at the $60,000 on ebay, BMW is honoring the ebay agreement as a lease?

BMW isnt "honouring" anything. Doom decided to use leasing as his financing option, per the auction terms, got the best deal he could (apparently) from a private lessor, and that lessor paid Huckster. Doom got the advantage of a low acquisition price for lower payments, I would assume. I dont mean to offend, but you apparently dont understand that a lease is merely a form of financing. Thats about it, right?

I actually think this recent press release by Husker is a good thing since it has the wrong intended effect by confirming Husker as what they are based on its unscrupolous conduct: a dealership entirely lacking of either honor or integrity. This time, Husker cannot claim mistake.

The perfect example of why dealerships are known as stealerships.

Great write up by autoblog.

Husker has some nerve.

At least they still get some sort of punishment; all the bad press, Ken gets the car for $60k and they have to still live in boring Nebraska.

Yes i would have to agree.

I posted some where in the middle of this long thread about my law suit with husker auto group.

Before this whole ebay bmw thing came up.. i actually walked into Husker Auto Group / Bmw of lincoln and spoke with Fil (current Gm) to talk about my bs lawsuit.. he asked a few questions, i explained how ive been having my service work done at the dealership in Omaha (markel)

He said " Have your lawyer call me and ill take care of it, im not in the business of sueing my customers"

Well of course my lawyer cant call him, so i "fired" my attorney and called Mr Zimmerman, Huskers local attorney and told him what Fil said to me in person to my face.

Mr Zimmermans said "Ok i wish Fil would of consulted with me before he told you that but i will him and confirm"

Well today Mr Zimmerman leaves me a message saying that told Fil that the lawsuit was only $500 (why would they sue me over $500?) and that we are going to have to continue in court / arbriation.

Well i drive out once again to husker auto group today to talk to Fil. I dont even hardly get in the door and he tells me i need to talk to my attorney. I inform that i fired my attorney because 3 weeks ago he told me he was going to "take care of it". He then said "well after discussing it with our attorney, you need to talk to mr zimmerman"

That mans word means NOTHING!!!! Im so fired up.. i luved all this bad press they got and all the quotes from huskers staff "we have an impectable service record" or the one i read on that post above "Husker honors all contracts", as said by Ryan Mathis..

What a waste of time... for everyone involved.. they fucked up and know it, just like in my particular case and they wont just give up...

Neither will I......

Dont million of people / business's / car dealers do that every day? (complete ebay transactions)

So should we all make press releases when we complete a transaction on ebay and honor the high bidders bid? I think ive done it some 200+ times? Wow i should fire my PR person.....

Husker is just so good at twisting the truth. Absolute blasphemy. Covered the $10,000 to make the customer happy? I didn't get that feeling at all, it was more like that they want to make up for the $10,000 deficit but realized the bad publicity and reputation costs way more than the $10,000...so they "honor" the deal.

Husker, up my a**.

I spoke with Ryan Mathis this afternoon, he stated the car is being picked up for shipment today. So thats good. Hopefully, its on a truck now, and not sitting at the dealership as we speak. Jeff, would you be able to confirm that?

Glad to hear you are getting closer. I hope things continue to go well.

Question: Approximately how much will you have to spend in Attorney's fees and other costs associated with this mess, caused by Husker "resisting" the $60K E-Bay auction bid, and giving you the "runaround" on financing? I am sure that I am not the only poster that is curious as to what your final acquisition cost will be VS a "clean sale" @ 60K without a hassle.
