No, the buyer couldn't make payment so was not able to purchase the car. Check the buyer's feedback. He did the same thing to another dealer, too.

There are loser buyers just as much as there are loser sellers on ebay, no?

Ok, here is whats going on. The details for paying for the car are complete, and it should be ready to be shipped tomorrow. Despite the dealer insinuation about finances (I blame my barrio, the mean streets of RPV), yes I qualified! I've asked Lincoln BMW to ship it to South Bay BMW and Philippe Kahn, South Bay's Internet manager, will go through the car with me when it arrives, and show me how everything works. South Bay's service dept will also check it out real closely. South Bay is my closest BMW dealer, and Philippe has been following this saga closely and volunteered to help. Phillipe and I talked today, props to him for helping set this up.

That said, I do have a pretty hefty legal bill to deal with. Scott's such a good guy, he has promised to reduce the fees but having worked so hard, he is the last person that I want to stiff. I don't care if I end up paying close to MSRP, but you got to take care of those who help you out. In this case, I wouldnt have gotten over the final hump without Scott. So, here is what Im thinking. I mentioned this before, but Lincoln BMW has promised to send the car to me with two license plate frames with the Husker cardboard inserts. I plan on using one of them. But I wanted to auction off the other license plate frame, with the Husker cardboard insert. Winner of the auction gets to
DESIGN MY CUSTOM CA LICENSE PLATE. And I will drive it around proudly, with an M3POST sticker.

What do you think? Half the proceeds goto legal, half to charity. More details on the plate will be posted as the time comes.
But Wait! There is more. Despite all thats happened with Husker, they were kind enough to place me on the dealer mailing list. Buy a car, and receive a coupon for 2 free tickets to Nebraska's Spring Football Game!! Husker was kind enough to send this yesterday. Assuming the dealership will honor their coupon commitment, I fully expect to see 2 tickets in my car when its delivered. These too, will be included in the auction.



Before anyone volunteers again, I absolutely refuse to accept any donations. If you feel compelled to, please bid on the auction (but please, no fake bids and I promise not to shill bid! BTW, I have 100% positive feedback)

So was it worth it? Judging from the overwhelming response from all my friends here at M3post and beyond, hell yes.

Laszlo, no I havent. The fact that BMW NA has not contacted me is pretty disappointing.

Previously, I owned a 2003 E39 and used to post on roadfly.org.
Back then, there used to be a person who would monitor posts and if there was a problem, they would always be on it, posting something to the effect of "I represent BMW NA. Please call us at XXX-XXX-XXX and we will address your concern. Anyone remember this?

Plate ideas such as "STOLEN" and "MISTAKE", come to mind.

If you really want to stir the pot with BMW North America (as if the pot isn't stirred enough), I would steer clear of [Chief Legal Counsel] Herbert L. Klein. He's just a jerkoff that spent 3 years too many in law school.

I'd go to Norbert Reithofer, CEO. Clearly you have an entre (from this post), and this is *not* good for BMW.

We're dealing with this over another marque, and it is too common that they distance themselves from dealers.

I'd actually go to Woodcliff Lake (NJ) and personally meet with them. They need to have better control - yes control - over slimebags like Husker's.

My final comment is that BMW sends out an army of field engineers if a taillamp causes a fire (even if it's due to owner error with regard to an improperly screwed in bulb), yet they send out a pre-canned email response over a serious matter like this.

As stated before, BMW NA just makes the car and sells them to dealers. They do not want to get involved with the problems associated with dealerships and selling cars (and why dealerships exist). Should there be a problem with the car, that's where their obligation starts and ends. And as this problem began with an auction, even more reason for BMW NA to stay as far away from this as possible. The one who gets dinged here is Hukster BMW but as I wrote this morning, you probably will not get a call from BMW NA as your phone number will be off a few digits and BMW will get some other guy on the phone who will say, "I never bought a BMW but if you are giving one away, i'll take it!" or a message "phone number not in service, please try again."

And let me not forget to mention EBAY. They obviously have shown that they have lost their way unless someone eventually got a hold of you and helped you out.

Anyways, congrats on finally getting this resolved. Maybe you should offer Scott the privilege of driving your car for a month or two as payment. Just tell him to make sure club girls don't stain the red leather seats!

This thread is a bloody monster. I keep reading and it keeps growing.

Congrats Dooma for finally getting the car. It is highly recommended you go over it with a fine tooth comb just in case fil decide to cut the brakes (LOL).

As a E90 owner myself, i am very disappointed that BMWNA did not speak on your behalf. On the other hand maybe they have privately given the dealership a spanking and decide not the join the PR fray. However, at the very least they should have called you and apologized.

Not to get in a pissing contest, but who exactly issues and renews BMW dealer contracts? Who trains the dealers? Who provides marketing material? Who outlines and enforces dealership design and requirements?

This is why BMWNA *DOES* have an obligation to get involved.

Unfortunately their INTERNAL SYSTEM PROCESSES can't support this. And by the letter of the franchise law, they don't HAVE to get involved.

I expect this to change over the next 5-10 years. Unfortunately not soon enough.

I understand your concern but removing all emotion over this soap opera, BMW has no obligation at all. BMW looks at the "overall" picture of how the dealership is doing. BMW understands there are going to be % of unhappy customers. If that % is high and the dealership shows a pattern, then they'll step in. If anything, Ken should contact Nebraska's DMV which, I believe, over sees dealerships and lodge a complaint with them.

Van Tuyl Automotive is a huge company. This might affect them short term....and that's a big IF, but otherwise, this will blow over sooner than you think and Fil will wake up every morning and say to himself while he spikes his hair with a pound of goop and blows kisses to himself in the mirror, "How many pounders am I going to make today?"

Ah, the life of a car's salesman.
