Bought Car on eBay and Dealer Will Not Honor Purchase!

I found a new '08 M3 coupe for sale last night on eBay for $49,900. I waited to talk to someone at the dealer this morning, and after I confirmed that the car is new I did the "Buy It Now".

I finally receive a call back after trying to get two sales guys to call me, and he is taking my information down and getting ready to get a credit card for the deposit. He then pauses for a second and says that his sales manager said that the car is sold! I told him that I already bought the car through eBay, and he said sorry. It's an absolute crock! I'm looking at other cars, but I want everyone to be leary of this dealership! They're trying to sell an '08 M3 sedan as well for the same price. Don't be surprised if it's no longer available.

Have a friend call and inquire about the car. Have him say he is considering buying a red M3 for invoice plus $1000. I'll bet that M3 is still available.

Don't go through all the hassle of lawyers ect. There are a ton of M3's out there and a bunch of dealerships wanting and willing to sell.

What I would do is communicate to eBay what transpired (talk to a representative about it live) They will pull the sellers account. Then I'd just make a courtesy call to the General Sales Manager tell him what happened and let him know that you have contacted eBay to have their account pulled and that you are now contacting the BBB, BMWNA, the state Dealership Licensing Board, and the local investigative news media (every network TV Affiliate has an investigative office) concerning this fraudulent transaction.

Sometimes demonstrating that you are not a pushover and do have a head on your shoulders will get you somewhere. Last thing a dealership needs is more bad press in this economy. Then mail a certified letter to the same manager summarizing your phone conversation as well as listing the names of who you have been in contact with at the said agencies (BBB, BMWNA, eBay, ect.) and let him know that if he as not been contacted by these people then he should expect to hear from them shortly and if he has any questions to contact you directly.

Well according to the eBay listing, someone else beat you to it. Car was sold to e***e at 8:12:59 AM Pacific Daylight Time. What time do you think you hit the "Buy It Now" button? Did you receive the "Congratulations" email from eBay? It would suck if another legitimate buyer beat you to it by 10 minutes (or 10 seconds), but these things DO happen.

No, the e***e buyer is me. I used my business eBay account to buy the car. I received the e-mail from eBay, and I also can still get into "My eBay" and see the car listed under "Items Won". I was told that I would get a call back, and I also sent two messages through eBay telling them that it was a binding contract and the manager needs to call me. I never received a call back. Before I started pushing it, I figured I would check with my local dealer. I remember driving a similar M3 coupe this time last year, and I knew that the dealer still had the car two months ago. I called the salesman I used when I bought my '07 335i new back in '06, and he said that they still had the car. I went and drove it again, and I told him that I had the winning bid on the EXACT same car from a dealer in Savannah, Georgia. Apparently they were both "launch" cars, so they were identical to the penny. I showed him the eBay auction, and he printed it out and took it to the sales manager. The first one would not match it, but he then took it to the GM and he said that he would match it! So, I ended up with the exact same car for the same price, and I only have to drive 20 miles to pick it up! It was pure luck that they did this for me. I'm still going to report the dealership in Georgia to eBay, BMWNA, etc. Just because it still worked out for me doesn't mean that they should get away with it! It still pisses me off, but it worked out better in the end.

FYI, BMW is now offering $7,500 off on the left-over '08 M3's! The car stickered for $69,745, and invoice was listed at $64,395. They initially offered invoice less the $7,500 rebate to put the price at $56,895. I said that it's a great car, but I really only wanted the car if I could get it for the same smoking deal. I can deal with it not being the exact color and exact options I want if it's cheap enough! It also helps that they've had the car on their lot for a year. SO, anyone considering a left-over '08 should take the $7,500 rebate into consideration! Apparently the rebate is new, and a lot of dealers don't know about it yet. Combine it with the 3.99% financing I got from Pentagon Federal Credit Union www.penfed.org. and it works out great!

Am I missing something? The OP got the same car for the same price from a local dealer and didn't have to deal with the eBay scamster.

It looks like from the eBay dealer's feedback, they have done the same thing before.

Really really happy for you that it worked out this way. that is awesome! Don't forget to torch the slimebags in Georgia though. the fact eBay shows you as the winner and they still backed out makes them the biggest douchebags of all time!

The above advice is the best option in my opinion!

Definitily contact Ebay about them...let someone buy a car thru "buy-it-now" with the price marked-up that dealership would hold your feet to the fire and threaten legal action and the whole 9 if you didnt follow thru. Also if you won the item you should be able to leave them Negitive feedback.
