California tax and out of state buyers

Im permanent oregon resident (no sales tax here) and apparently i have to pay sales tax to Cali or my car will not leave dealers lot no matter what i try, driving , flatbead, delivery track, sideways or upside down. Can you guys share your experience with this? What about buying from a private seller?

When buying a car in other state you pay taxes based on your state.

For example in South Carolina when buying a car the sales tax caps out at 300$ so when I was quoted buying a car from a dealer in CA. It was the price of the car +300$ South Carolina tax. Nothing more and no taxes to CA.

That is what my understanding was until today, but it is not what happened to me, Carmax at irvine CA told me i have to pay around 5k in taxes on top of 55k car price, thats why im wondering if im missing something or what?

I work for a dealership in CA, you have to pay CA sales tax if you want to drive your vehicle out. But if you truck it, then you don't have to pay the tax, you would pay your tax in the state your reside in. If you finance the purchase, you will have to include the tax rate of your state into the finance (if any applicable).

Are you trying to buy a BMW? Have you contacted the guys at Steve Thomas BMW? Ryan Amico or PM Golfrr?

I dont work for a BMW dealership, but I'm sure all CA tax laws apply to every dealer.

tax follows where you live. You only pay cali tax if you live here. This is from what i know, i may be wrong

You shouldn't have to pay sales tax if you truck it, perhaps not even if you drive it as long as you don't register it in CA. But you WILL have to pay tax in Oregon if applicable (sometimes this is called Use Tax) because that's how states with sales tax prevent people from cheating the system by buying in a state with no tax. That said, most states with a use tax allow you to deduct any sales or use tax you've already paid elsewhere. When I moved from CA to TX, I got to do that.

Ohh i told them about the "truck it" option too, they don't wanna hear none of that, if car leaves their lot they have to collect taxes end of story. Sales manager sounded like she had a bad day too.
Yes i "was" trying to buy BMW from non-bmw dealership.

The way it works is this.

If you buy out of state and drive it off a CA dealership then you are responsible for CA tax.

If you truck the car off the lot you pay tax wherever the car is registered

If you drive the car off a CA dealer pay the tax then go to your state where the tax is cheaper you won't be able to get a refund.

also I am not certain but I will ask Ryan, If you buy out of state and drive the car there and it just so happens that the tax is "lower" then where you live, you will have to pay the difference when you goto register the vehicle at your residence. So keep that in mind.

You will need to educate sales manager, I've bought 2 used cars from Cali and had them both trucked to my home state without paying CA sales tax.

if its carmax, find the nearest carmax to you, tell them you want to buy a bmw from the other carmax, they will do the transaction, you then pay no sales tax since you are buying it from your dealer in your state, then pay them to ship it. I once inquired to buy from a florida dealer and shipping from carmax is $900 so I assume shipping from ca to oregon will be cheaper.

If you go to Carmax's website and search out cars, most can be transferred to your local Carmax for a fee. No biggie.

Got to ship my cousin's Cayman out of the country. Couldn't drive it on the road. Otherwise I had to pay taxes. Thus, the shipping company picked-up the car from the Porsche dealership, and had it taken to the port.

Yup, you do not have to pay any sales tax. I have a California driver license and reside in Oregon. I buy my BMWs from Washington state because I have found them much cheaper then Oregon. No tax has ever been paid. I looked at a couple from dealers in California and no tax would have been paid either if trucked out. I had to educate a couple dealers in Norcal on this but they agreed but never did it.

i am going to buy a M3 E93 in this week from an owner, and he said that is ok for sell to me as a gift, can i avoid the tax when i tranfer the title?

Gotta love CA. I guess you can lie about the actual sale price but in CA you do have to pay sales tax regardless if the purchase is from a dealer or a private party.At least my understanding. But in most other states you do not have to pay sales tax if purchasing from a private party.
