+1, I think this is what may of happened. Haha, typical.

However, given your car is pristine, you have the bonus CPO, and you're generally happy. Why unearth a headache?

If she was hot, you could just ask for a little "added value", that might be worth it...

Why are you upset about this?! Doesn't make any sense. Now you have 2 extra years warranty!

lol, it would be impossible for a rational person to say "there has been only one owner of this car" when she meant that there was one owner before her and she was the second.

if this was how it played out in any purchase i made, i would consider the seller a bald-faced liar. that can't be any kind of misunderstanding.

Pretty angry about this misrepresentation from the seller - she was in the fact the 2nd owner, and not the first - though the car was (and still is) in perfect condition.

Weighing the pros and cons of confronting the seller. How would you guys react to something like this?

Would a confrontation be an overreaction? Seems like a pretty dirty trick to pull.

Edit: had full BMW inspection / car fax / etc. before purchasing - not sure how this detail didn't arise.
You're overreacting. Most people would be ecstatic to have a CPO warranty on an 08.

i'm not selling the car - so ultimately who cares - and i'm going to assume that it was a mistake (my intuition tells me that it was something different, but i'm letting it go)

still, if she purposefully mislead me as to 1st v. 2nd owner - well, fuck her. that's a pretty big thing to lie about, and it relates directly to the value of the car. material misrepresentation / fraud in the inducement / breach of contract yadda yadda yadda

so as to what i'd do about it? call her and say: "hey, you're a liar, go fuck yourself. good bye." end of convo.

Maybe I'm uninformed, but how much does the value of a car really change from 1st owner to 2nd owner to 3rd owner and so forth?

I'd say the value of the CPO warranty would add more to the value should you ever sell it than the number of owners would detract from value.

it's weird to me that only a very few think that i should be (potentially) upset by discovering this detail. 1 previous owner or 2? That's a big deal - right?

i think that the fact that the seller was a "she" and not a "he" has skewed everyone's perception here.

In any event, the car is been heavily modded. I seriously doubt that the dealer who refuses to update the ECU to 240E under the warranty (but offer to do it for $330 ) would honor that same warranty once discovering, e.g., pulley, tune, etc.

So no, not really excited about the CPO warranty that expires in April on a heavily modified M3.

CPO car is always a good thing buddy. Dealer does a thorough inspection on a particular car; not all cars qualify.

I never said anything about wanting to sue this person - it was a question of whether I should confront her.

As mentioned, I'm going to just assume that it was a mistake / demo and leave it at that.

But I honestly don't understand the whole "oh yay i'm a 3rd and not 2nd owner" thing that you guys seem to be suggesting. excuse me for not being enthused.

What probably happened is the person you bought it from was the original owner except it was leased. When the lease was up they bought the car with a CPO. This appears as 2 owners even though there is really only one.

No it's not. How long have you had the car? Has it run really well and been trouble free and reliable? If so, why get all upset?

What would be a big deal is stuff like if she said it was accident free and had actually been in an accident, or if she said it was in perfect condition but had been lemon-law returned or something like that.

The number of owners is completely irrelevant if the car was well maintained, and runs well, and is reliable. I bought a 300ZX TT with 2 prior owners and about 24K miles. I drove that car to about 100K miles and it was the best, most reliable car I've ever purchased. Number of previous owners means absolutely nothing. Get over it.

Frankly, I'd be more pissed off about the dealer not willing to update your ECU than the prior seller not disclosing it had 2 previous owners.
