I got the NHTSA e-mail and responded with my personal case of lag merging into traffic. I filed the complaint using a link found in this forum. I had never expected NHTSA to follow up with it. I am curious to see what happens next.

Complaint filed with NHTSA (with VIN). I have had many scary occurrences of this issue.

There is a software update available. Your dealer should install it as long as he can verify the lag is present. We have heard very good things about the near elimination of the lag (in some cases reports of total elimination) from the new software. Mine it being updated as I type so I don't yet have personal evidence. Read the other threads on the topic and get your software updated before you file your complaint. That is only fair to BMW and is the logical thing to do.

I get what you're saying, but if you're just some Joe on the street who isn't on this board all the time, you would not know about this update at all. It's still a dangerous situation that BMW is only now starting to admit is a problem and not "normal operation" of the tranny.

Let me get this straight... You are swapping out parts designed by some of the top engineers in the world because some guys sponsored by a company told you it's "better??" But when you ask the same guy about tracking, "oh no, I have a kid now" or "I just detailed my car." or "i just got new tires."

They didn't mention what update I got on mine. I did get the update but did see the lag again yesterday. The update attempted to resolve the issue on my car but I have found after the last few days of driving that it is still there.

I just got ISTA/P 2.33.0 installed and the lag is greatly reduced. It is basically "ok" now. I wouldn't mind driving it like this from now on.....the only time I noticed any lag was when the tranny was obviously involved in a downshift. Even at that, it was fairly short.
It is MUCH improved....but not perfect. I don't know if we can get much better? I will report back on the lag over time as it may reappear as it could be related to adaptation (maybe why some have it and some don't). Time will tell....but I got my fingers crossed. Also, I have only driven it a short time and I will be out of town for 10 days now. So i wont have a chance to put any miles on it until August. I will report my observations when appropriate....

I am new to the M3 DCT car, but i have really yet to read about learing capabilities of the car. I know in some cars, like my old lexus 1999 GS400, if you drove lightly it would learn your pattern and therefore would make things accellerate smoothly rather than quickly, and so i had to unplug the battery so that it would relearn.
Does the M3 have some learning capabilities that might also add to the effect of the lag? Anyone know any more depth about this? Quote:

It is still an open debate. Whatever the case, there is no communication from BMW that advertises learning capabilities for the M-DCT transmission. At least none that I am aware of. Contrast this with BMW's Steptronic transmission, where the adaptive features are documented and part of the marketing of that transmission.

No one knows. I'm just happy they got this one out. Though it would be nice if they really fixed it. At least they can't say it's "normal for this transmission."

Attached bulletin states it supercedes the Jan 2009 bulletin, so it is definitely a 2009 bulletin and issued after your car was built
