Firm organizing class action lawsuit against BMW for E9X M3 bearing failures

Big thanks for member JEllis for mentioning this over in the other lawsuit thread. There were members that felt that this latest development needed a new thread, and I happen to agree.

Doing some quick searching, this isn't their first rodeo:

http://www.classadvocate.com/classaction.php?id=403

http://abnormaluse.com/2010/09/class...ayon-odor.html

http://www.chimicles.com/toyota-scio...action-lawsuit

It would be great if those that experienced failure will contact them so we can hopefully see some progress and finally get something done.

OK...Macht Schnel!
This is the moment we have all been waiting for.

For you people out there with a failed engine associated with a bearing issue please contact these above lawyers. They are putting a class action together and need a plaintiff around which to build a case. No money will be required from any of us to get this done. If successful, then prior, present and future enthusiasts affected by this specter will have a remedy.

By the way, a major salute to Regular Guy, Kawasaki, BMRLVR, et al, for their incredible work in bringing the M3 community's enlightened members to the level of understanding necessary to make this possible. Your collective dedication to the issue and to the good of the M3 community has been absolutely stunning!

For those in the other thread who are pledging cash for a mysterious expert to review the facts of the issue: perhaps skip it and save your cash. I have a feeling these issues will be fully vetted by the expert witnesses during the discovery process.

Buckle up and enjoy the ride.

I hope it's as successful as the s54 bearing and e46 subframe problems/solutions. the people involved in both of those cases deserve a huge high five from the community.
I hope this one is as successful.

Did any of these lawsuits result in a win? Reading the 3 examples, it appears they all failed. Is that correct?

I would have chosen either (perhaps they were the same) firm that represented the e46m owners. I hope they have a Johnny Cockren on board.

While the subject matter of class action lawsuits can vary widely, two factors are almost always present for every class action:

1.the issues in dispute are common to all members of the class, and
2.the persons affected are so numerous as to make it impracticable to bring them all before the court.

Often they settle. The lawyers get paid and you and I get a coupon for a discount on a future purchase or $2.50, whichever is less.

I was involved with a class action suit against Health Net a few years back, I was pleasantly surprised when I received a $14K check in the mail. I am sure it will be more than $2.50 (which I know was just being sarcastic..)

This is what I thought happened to the other thread. The guy said he would reach out to the lawyers who won the cases with the N54 community and then he popped smoke.

To quote the venerable Pink Floyd...
Que the ominous music:

"Is there anybody out there" ...with a blown engine?

After countless hours of time, energy, debate, and thought regarding the S65 bearings shortcomings, this thread seems to have fallen off the first page edge into oblivion. Impossible I say!
Seriously now: there are professionals at the top of this thread ready to rock and roll this issue to court on all of our behalf. All they need is a case to represent. Thereafter, if successful, we hopefully will all benefit from the settlement. In a perfect world, perhaps we can have a fix to the bearings or get an extension of our warranty. At any rate, this thread deserves major attention from all concerned with this issue!

Let me give you an example of what happens in a class action lawsuit. The Lexus SC430 had some problem with the computer. My wife's is a 2004. I was informed the newer cars would be fixed but because ours was older we would receive $100. $100 dollars for a $68000 car. The Lawyers received $250,000,000. 250 MILLION dollars 1/4 of a Billion. They only made about 75000 SC430s. That's $3000 a car. There is nothing anywhere anyhow deserving of that much money. If you do a little more math, they get 97% and I get 3%.

If there is a suit, I'm sure the settlement will be similar.

Care to link to any information about that suit? I'm skeptical of those numbers.

But even if the numbers are accurate, that's $100 more than you would have gotten without the lawsuit. I've never seen people more ungrateful for getting money for doing nothing than class-action detractors.

I received a heck of a lot more than $100 when my E46 M3 had its recalls fixed through Class Action lawsuits.

Everyone always bashes on class action law suits. I was involved in one against red bull for texting me without authorization, yet I don't even remember that ever happening. Regardless, I signed up and got a $200 check. For a supposed single text message. Someone should forward this thread to everyone who's had a failure.

When Jimmy Johns told me I would have alfalfa sprouts on my sandwich, I was irreparably harmed as I took a bite and realized I had been flat out lied to.

Thank god there was a class action law suit last year, and I was able to claim a free pickle for my trouble. The settlement was worth it.

I got a pickle with a face value of $1.40.... the lawyers walked with $370k.....
