Speeding Ticket in NY

Not me but a coworker got a speeding ticket in NY. 83 in a 65. It doesn't list the amount on the ticket. He has the option to appeal but not sure if its worth the drive back out to NY for the appeal.

Any advice on out of state tickets? His concern is his insurance will go up.

I would lawyer up and have them delay it for as long as possible. Might be cheaper than insurance going up.

If its out of state, then he won't get any points. I would lawyer up and try to lower the cost. Majority of courts will offer plea deals that can cut the fine by half. They'll cut the points as well but that won't matter to him.

As for insurance, even though he won't have points, they will still find out about the ticket and most likely increase his rate.

If your friend shows up with a Bawston Red Sawks logo in a NYC courtroom, the judge is likely to hold him in contempt of court, throw him in jail for 30 days, and fine him the max allowed under the law...all justified mind you

Where does he live? I'm positive ny transfers points to those with a nj license and vice versa. My advice would be to hire a lawyer.

Points transfer from ny to ma. Hire a traffic ticket lawyer specialist and fight. Insurance impact is starting to be very significant from almost all insurers.

Insurance points will transfer between most states. Not sure about points on your license. Easiest solution is to just pay an extra couple hundred for a lawyer to take care of the whole thing for you. Saves you the trip and headache.

I got a speeding ticket in NY couple of years ago. Even though I am from Canada but what I found through research was the fines do transfer between neighbouring states and that rule applies with Ontario as well(so my insurance would have gone up).

After weighing all my options, I found a local NY lawyer with good reviews, paid him I think around $400 and he was able to reduce the fine to just a parking ticket of around $100 I believe. He told me all the state really cares about is getting your money, and in most cases they do reduce it to parking fine.

Get a lawyer and don't bother with delaying the ticket because of insurance. Insurance will go up after the judgement... not on the date the ticket was written. Just a waste of time to delay.

after you hire a lawyer don't expect the burden to be lifted off your shoulders. If you don't scout behind the lawyer you may have surprises. One of my employee got a 56 in a 45, she paid a lawyer to take care of it, lawyer said no need to accompany him to court for that, she got points saved but original hefty fine was kept the same+ $140 lawyer bill. Lawyer did the absolute minimum probably not even walking to court.

Ok.... I JUST went through this EXACT situation, 90 in a 65 in upstate NY. I live in PA.

The first call should be to his insurance agent; be absolutely positive about whether or not the ticket will "cross state lines." If it will, as everyone states here, contact an attorney.

If not, he can handle this himself with little hassle. Plead 'Not Guilty' on the ticket and return it. He'll receive notification of his plea, and be asked to supply both an abstract of his driving record from MA (easy to get free on-line) and a narrative expressing why he's pleading not guilty. Tell him to make sure he asks for a reduction in fines and penalties. The court will assess this and get back to him.... I had mine reduced from a 6 point infraction to a 2 point infraction.

Don't waste your money on a lawyer!

Depending on your state, points may or may not transfer. You can usually find that out online.

Insurance will most likely pick up on your ticket and increase your rate. Depending on how young the driver is, past driving history etc., the increase may only be a 100 or so dollars for a 6 month premium, if not less.

The ticket will probably be reduced to a 75 in a 65 zone with a plea bargain. This is after you plea "Not Guilty" and show up at your Pre-Trial Conference to meet with the DA who will basically just throw you a reduced-offense offer, and you'll accept. Then just pay & leave the court.

If you plea guilty to avoid the trip back to NY, expect to see a court surcharge of around $85 (even if the ticket was dropped 100% - you'd still have to pay this. Bullshit) and a fine of around $200 or maybe a bit more. A Lawyer will definitely cost more than this, so again - don't even waste your time or money.


Hope this helps. I've been through this many times in NY before. I hate living in NY (upstate) and can't wait to get out of this shitty state.

I think your stakes were considerably higher because more than 20mph over the speed limit is reckless driving.
