Yep, not a lawyer either but local media talking about murder charge being reduced to manslaughter. Smith was shot in the back and had no weapon on his person even though he may have threatened to get one. Not sure how that will play out in court...

Smith had a concealed carry license and a 9mm in the car. Regardless I don't see how it could be considered self defense. Smith never took the weapon out the car and was shot in his back. Also after smith hit Hayes he drove off. Hayes followed smith and slammed the hummer into the back of smiths Mercedes and that's when everything escalated.

Agreed. If Smith had actually retrieved his gun from his car and turned toward the shooter then he has every right to protect himself. But shooting an unarmed man, making verbal threats or not, in the back is a crime.

Not sure which is better. Legislate guns so people can't have them, putting those without them at considerable risk-or have everyone have them.

I don't know.

no way is this self defense. He shot Smith 8 times total, 7 in the back, and shot his wife twice in the legs. Some reports saying the wife was shot 1st, which definitely doesnt follow the logic of "i was afraid will smith was gonna kill me" defense. Maybe shooting him a couple times you could see self defense, but this looks more like a murder.

Reports are coming out that witnesses overheard someone say "Ive got a a gun" and someone replying back "Ive got one too", but no one really knows who said what 1st. Still, whether or not Smith said he had a gun is irrelevent, because he didnt have one on him and never brandished it.

Yes smith did hit him 1st and took off, but then Hayes chased him down and rammed him with his hummer. Everything points to Hayes being the aggressor in this. Also, the video thats been leaked doesnt show anything leading up to this point, and im guessing there is even more that happened before all this.
