+1 on the E90 version. Somebody in the LA area needs to get their E90 over for fitment!

The Scuderia diffuser is the sexiest diffuser ever. If you can replicate that into a E92/90 then that will be a huge seller.

Keep the Middle fin or use 2 fins (very good idea). It would look a little 2 flat and lack dynamics if you had no fin. If you go the single fin route make sure that you have unique dimensions of the fin and it should be significant from what the "other company" has (.25in min in several measurements) Also, keep all docs, drawings, correspondence of even the idea of this and you should be OK legal wise (especially if your design is outside the 15% realm)

I could be enticed to offer up my e90 M3 for design and dimentions. I am in LA area. Get that one to market first and the "other company" could be the one having legal issues as I don't think they have any current intent on an e90 version (not that I have heard at least)

Just shoot me a PM if you want to pursue...
