Lawsuit help? Rusnak BMW?
Hey guys i recently picked my car up from the dealership today and ran into issues. So this is my case, i dropped my car off friday morning at 730 and they said it would probably be done around 2-3. In fact the BMW service guy told me that they didnt start working on the car till 2-3 ... which i dont understand since i was his only appointment. Not only that but he had to order parts and he said monday so i went with a loaner. When i brought the car back, and went and saw the cashier and got my car it took about 20-30 mins for them to bring my car out and i kept hearing the car start and stop. In the parking garage they had. Eventually i heard it coming down a ramp... And the person driving it just free revving it... which pissed me off especially from BMW, and when he came down he smacked my 1500$ carbon fiber lip and it made a loud crack and my body shivered at the sound. He pulled up and i gave him the receipt and drove away. Anyways i went home and saw a lot of damage on my lip. I do not want to sue, but i asked him to top off my oil via text message to my advisor he said yes he will, and of course the oil was not topped off. I also know there was some joy riding involved due to the fact my gas was at 1/4 and when they gave me it, it was at 3.5./4 which i thought was strange... They may have gas pumps in the back im not sure... im just curious if i can make them pay me for a new lip or something not looking for a crazy law suit... Also i thought it was completely unprofessional and my service advisor did not even say sorry all that was said was, ok email me the complaint so i can send to my service advisor and that was it. Thanks for the long read !

Should i have stayed there? what if they have video of him pulling out? and hitting the lip?

You should stayed there and fought with them, at least that's what i would do. On my first 1200 mile service, my dealer scratched my new lip clear bra, and i was bitching about it and they end up giving me 3 free oil change service haha.

Yea OP the thing you have to understand is that you need to be assertive at the dealer.. you are the customer..I mean I find incredible that you witness the guy smack you lip and you didnt say anything to him and just drove off..you must be a pacifist..
In your position I would have went off on the guy and marched straight to the managers office and not left till I had a check in my hand |

That sucks man. Here is what I would do:
-Remain calm until you have hit a wall in negotiating. -Call your SA and tell them that they damaged your lip. -Tell them you want them to replace your lip. How bad is the damage? ...go from there. Typical escalation is SA -> Service Manager -> General Manager... Good luck. |

None of the local Socal shops have a good rep. A search would have told you that. That's why even though I have to take time off work to go there, I will always take my car to Steve Thomas. They do great work, no joy rides, no BS! What was your car there for in the first place?

They were replacing a subwoofer which I told them to change ... Because it blew apparenty they said it was the amp. So they replaced the amp and then said they have to order parts, I said which parts and they said subwoofers so I was like well... I told you that's what it was from the start. If I go in today and speak to the service advisor how should I approach this.

RUSNAK Westlake are theives! I bought my Cayman S there back in 2008. Long story short, they tried to switch up my loan (bait and switch) after converting my lease to a buyout! I called the manager and told him to f*ck himself and f*ck his car. I told him the car is his, and I was not returning to the lot to pick it up....He called me back twice and i said F U! and hung up. He eventually got through to me and lowered the payments by $400/mo and I made him throw in every warranty available for free!...Windshield, tire, wheel, dent, etc... What an idiot. He ended up losing more money than he would have if he stuck with our original deal.
On the service side, They charged me $700 for an oil change. After that, i never came back. I also posted negative reviews on yelp. FU Rusnak!

Once you left.... you opened the door for them to suggest that the damage was caused elsewhere.
Now you have to hope that the tech steps up and admits that he did cause the damage (unlikely). Best of luck!

Nonsense about leaving. Sure it is better to handle at that moment, but they caused the damage, so have an adult conversation with them and figure it out.

Finally talked to them! Service manager handled the situation somewhat, his forman is looking at the car when its up on the lift and was going to most likely sand down and refinish it all unless its cracked, then they will be buying me a new lip. Somewhat impressed. =D
