thanks for those with real replies, sorry flamers for the long post.
I was at work and had no time to retype it all, so i just copied it from what I sent to my lawyer. In conclusion, I will figure it out with BMW NA like some have suggested. Not sure on BMW anymore, might just go pick up a GTR again, I had no problems there, or on to a Porsche!

look for some RPI scoop and Lux angel eyes on sale soon

my favorite part of the story was how they said they couldn't replicate the problem because it was summer. don't they have a fucking hose?

You need to get the service manager on your side. You need to call BMWNA and state your grievances and have them get the ball rolling by contacting the service manager.
You wont get all your money back even if your situation meets the lemon criteria. That's because you used the car. There is going to be a depreciation factor based on mileage which will affect how much you get back. I'm pretty sure this is the case even under California law.
I just had a buy back from BMWNA and it's not that easy doing it yourself, 6 repairs with two different dealers and could not fix the roof due to squeaks & rattle. Finally got an attorney involved and BMW agreed to do a buy back within three weeks and I just turn over the car today. If you need help I can hook you up with my lemon law attorney.

I had a buyback, too. No lawyer was involved. Just me, the service manager and a rep from BMWNA. The BMWNA rep told me my situation fit the California lemon law criteria and, as far as they were concerned, the solution was straight forward - they would buy the car back. I got money-in minus mileage depreciation.
I wouldn't say it was a fun time going through the experience but I thought the whole thing was professionally handled by all the BMW people involved. So, I just turned around and bought another one of their cars.

The thing that bothered me the most is my local shop & BMWNA rep would not admit they had a problem blamed it on the design of convertible, that is why I got the lawyer involved.
