2009 M3 DCT Lag?!?!

Hey guys, just about to pull the trigger on a 2009 m3 with dct but am worried about the recall that happened with ppl having problems with the shifting after breaking and accelerating. i know they released a software update after the recall, anyone know if its been fixed now. I'm getting the cars service history tomorrow morning and the car has 34,000kms should i be worried about this issue?!

As part of the deal insist that the car has been loaded with the latest software and all will be fine.
