IMHO BMW will decline repair if/when the tranny fails from lack of fluid. They will throw this in your face that you were warned about leak and didn't fix it, thus your fault. I had a similar situation with jeep, did not end well for either party.

I know you are going to do it yourself, just be concerned about their "double speak."

I have no idea and don't care. The warranty covers whatever it covers, and the dealer will do whatever BMW dictates and pays for.

Again, not a dealer issue. It's a BMW NA issue - unless you for some weird reason think the dealer should pay for any repairs that BMW doesn't cover under warranty.

My point was never about them having to cover it if BMW is denying it. Don't know where you got that idea from I haven't found anywhere in the warranty including the fine print where it says that the pan and gaskets are not covered and nor has the dealer showed me anything related to that. The only thing it states as not being covered is the clutch packs. It is frustrating because almost always the first reaction by the dealers is to deny coverage under warranty.

So did you bring that up to them. Did you show the contract for warranty that says this is a covered item?

For what it's worth, I agree with you that this seems that it should be covered. However, the fact that it is not excluded is not a good argument for you to use, if you choose to argue it. Generally, warranties are cover what is expressly stated as covered. It is "positive" coverage. They won't cover it because they haven't said they don't - they will only cover it if they have said they do. I do get the difference, that this is arguably a Powertrain Component, which is expressly covered. Just be careful with your wording if you choose to argue it. Good luck with your fix. It seems that doing this one yourself is a good option, given that it sounds like you have the skill for it.

Not a bmw dealer but while shopping for the new Lexus IS250 for my sister, when asked how much horsepower it has, I was told "about 380hp."

Put on your asshole hat and complain like a real BMW JERK owner.
1. Go up the chain of command.
2. Don't allow him a phone call see him face to face, this will waste his time. (yours too but its the principle of the thing)
3. Have him show you where in the warranty exactly it states this is not covered.
4. Have him sign a form that states what is stated " leak poses no real cause for concern" that you are not changing the pan because of this statement and if the entire transmission falls apart that it is on BMW to fix it since "leak poses no real cause for concern"..
5. Also mention ... that a "suggestion" is not a recommendation and that they are not confirming you should do anything....If they are recommending it they would probably have to cover it under warranty. Tell them that you are confused and that by deduction if they state "leak poses no real cause for concern" than "suggest that it be fixed"...then isn't this a recommendation to fix it?..Tell them this is misleading and they are contradicting themselves and confusing you. Mention that misleading statements like this is some kind of consumer fraud..and make a ton of shit up and mention that your dad is a lawyer...and that he suggested that you come and talk to him....

They will fix it..fuk heads ...
