Here we go again

I was rear ended this afternoon while driving in traffic in Houston. This is the third rear bumper that has been destroyed on my 2011 M3. This has all happened within 2 years. I fucking give up. Oh, and the insurance company that screwed me on the second incident has another crack at me. At some point in the not too distant future I am going to give up on driving a nice car in Houston.

Take 6 of these and THEN deal with the insurance company. There is honesty in alcohol.

They are insurance companies. There sole goal is to get your premium then pay out as little as is legally possible. This is how they make money.

People always get to close to me from the rear view..I think its the idiots that want to get a closer look at the car..

How to do you get screwed by insurance after getting rear ended?..It is automatically the other person fault..ALWAYS

In Texas, if an insurance company can not get a statement from their customer they do not have to pay out on a claim. They have 30 days to make documented attempts at contact. Hard to believe, but true.

Even if there is a police report? Maybe if you guys simply trade info and go your separate ways with a police report I could believe this....

You would certainly think that my description was wrong, but I spoke with individual's at the state insurance board in Austin, as well as my agent that is a top flight broker. Also, I am tenacious and for several days refused to believe this, until it was explained to me how the insurance lobby in Texas works.

WOW if true Texas is definitlely in the insurance dark ages..I would have sued the person directly in small claims court.

Suing an illegal with no permanent address, and no possible way to locate them. I sue them in small claims court and they don't show up, so I get a very hollow victory. I win, but have no way of collecting money.

I appreciate the incredulous posts of those that refuse to believe the facts as they are. Typically, educated people are taught that our system allows redress for grievances. All I can say is, when you are seeking redress from an individual that has no financial resources, and in my case, no legal residence status, time to bend over.

They provide an address when they apply for a driver's license and then can easily move on without updating their place of residence. They can easily disappear.

Not to beat a dead horse.. but almost every state requires social security number, passport verification or other proof of identity and proof of residence (utility bill, etc) I dont see how an illegal gets a drivers license but I admit I'm not up on how it works in Texas

No, we have plenty of that here in New Orleans as well! Did you wait around and get a police report? If you have a police report clearly stating the other driver is at fault, you still need this statement from the driver at fault to get the insurance company to pay? Just trying to understand how you got screwed...

Police, in Houston, will not come out to an accident where no one in injured, and all vehicles are drivable. I had a police car stop at the scene of one of my accidents, only to ask if there were any injuries. When I responded no, he rolled up his window and left. I could have clutched my chest and collapsed, but I'm confident I would have been arrested for lying to a police officer.
