I found the answer to when you can use force to protect your property in Texas:

Deadly Force to Protect Property

"A person is justified in using deadly force against another to protect his property to the degree he reasonably believes the force is immediately necessary to prevent the other's imminent commission of arson, burglary, robbery, theft during the nighttime or criminal mischief during the nighttime, and he reasonably believes that the property cannot be protected by any other means."

"A person is justified in using deadly force against another to pervent the other who is fleeing after committing burglary, robbery, or theft during the nighttime, from escaping with the property and he reasonable believes that the property cannot be recovered by any other means; or, the use of force other than deadly force to protect or recover the property would expose him or another to a substantial risk of death or serious bodily injury. (Nighttime is defined as the period 30 minutes after sunset until 30 minutes before sunrise.)"

Remember, you can kill the asshole if it happens in Texas, as long as it is night time.

Seems like the scratches are very deep on the hood and the trunk.

I already filed a report with the local police and filed a claim with my insurance company. Insurance company referred me to there certified body shops but not sure If I trust them with my M3. Any suggestions on body shops in SoCal? How bad does the damage look? Is the whole car going to need repainting? The taillights are really scratched up and might need replacing as well. Thanks for your input
While this absolutely sucks, I am curious as to why you left it out on Halloween night when you have a garage?

SAN JOSE (AP) – A San Jose woman has been arrested for the seventh time in the past three months, accused of vandalizing luxury vehicles in Alameda and Santa Clara counties.

San Jose police arrested 30-year-old Nancy Chi Ni on Saturday after she allegedly vandalized a BMW 335, a Honda CRV and a Mercedes-Benz E-320 at Westfield Valley Fair mall.

Police spokesman Officer Jose Garcia says was Ni booked into the Santa Clara county jail on suspicion of three counts of vandalism and one count of committing a felony while out on bail. The San Jose Mercury News reports Ni had previously bonded out following an arrest for a similar offense.

SheriffÂ’s officials says Ni is being held on $1 million bail.

Attorneys representing her did not return messages or declined to comment.

A San Jose woman already facing charges of vandalizing luxury cars in Santa Clara and Alameda counties by scratching the paint has been arrested again for allegedly gouging two vehicles with a pair of scissors, authorities said Wednesday.

Nancy Chi Ni, 30, was arrested Saturday in San Jose outside the Westfield Valley Fair mall, where she allegedly vandalized a Mercedes-Benz E320 and a 2007 BMW 335i, said Amy Cornell, spokeswoman for the Santa Clara County district attorney.

Ni was out on bail at the time. Prosecutors believe she is also responsible for taking a pair of scissors to luxury cars in Pleasanton, Milpitas, San Jose, Santa Clara and Sunnyvale since June.

All the damaged cars were BMWs or Mercedes. Prosecutors aren't sure what prompted the attacks, and noted that Ni herself drives a 2009 BMW 328

What about old people? Those daffy bastards are usually insane and out of control!

Love it! I like how the law gets around red-tape by using the word "reasonable" liberally.

OMG, EXACTLY what I would do...but I would turn my Boxer loose on them! Looking at these pix simply disgusted me. However, I am a HUGE believer in karma. One day, who ever did this to your car will be paid back, that you can believe. I'm sorry for all the anguish and trouble you now have to go through to get your car fixed!

E90 ZCP - I am late reading this, but let me join the others in wishing you all good luck in the repair. I hope that someday they will catch whom ever did this. Look forward to pictures of the completed project.
