Is it true Warranty is void if you run TOP SPEED??

i have been told that your car would be considered "tracked" if you have hit the rev limiter/top speed..

is this true..??

i've done 190mph in a car and 174mph on a bike so i have no urge to top out the M.. but i have topped out all past vehicles at one point or another (no BMW's).. so it would be nice to know i could and not lose my warranty..

well the speed limiter is below 190mph on the m3 so you wont even reach its "top speed" as long as you dont over rev your engine, maxing the car to the speed limiter wont void your warranty. i maxed out the limiter on my e90 328 once when i had it and i went in and out of dealer service with no problems at all.

Even if you track your car it doesn't void your warranty according to BMW USA M brand manager Larry Koch. The only exception is if you're racing it or in a contest.

Why would it be? If you are operating the car wihtin its designed limits, it should not effect your warranty coverage.

Yeah, that is my understanding.. no "competative" motorsports.

Hell, if they tried to void you out for "tracking" the car (no competitions!), you would win that case too...they advertise the car being used on the track. It is in their brochures, vids, etc. There is no way that they would win in court saying that being as you took it on the track, your warranty was void. lol

Well, there is an issue to think about here.

It's a well documented fact that the car records the fastest speed achieved. If you exceed the factory limit, then it's quite obvious that you have tampered with the cars electronic control units (specifically the coded limit in the DME unit, at least).

The question is, can they void warranty on the basis of this alone? Sounds unlikely, but I think it would be possible to deny coverage in certain situations.

Just curious...does "racing it or in a contest " include competitive tracking, or does racing or in a contest refer to street racing or something like that?

My interpretation is that they are referring to timed competitions with published results.

is there a such thing privacy act on this? I mean...they shouldnt be any tracking device or a blackbox in car(if there is one) without your acknowledge.

i have been told that the key is like a blackbox.. a dealer plugs it into their port and can pull up info about the car..

(food for thought).. and if you used one specific key only to take the car the dealer, a "clean key" would that make any difference...

m3=no real black box... Nissan GTR=Blackbox STANDARD!

I read into the OP's question as top speed as in limited top speed. I understand your point about if the car was chipped and you were recorded at 185 or whatever the true top speed is. THEN you may have an issue as you were exceeding the cars "manufactured limit". They could easily argue that there was a limit imposed by them at time of manufacture to avoid breakage, etc. and you over rode it, causing the damage. However, you would still have the Magnussen-Moss Act to fall back on....but it would be a slippery slope I think.

I don't think that they could void the warranty based on the fact that you drove past 155mph. I think it would be solely on the basis that you had to tamper with the ECU settings to attain that top speed. Even though the top speed limiter is a simple adjustment to an ECU tuner, BMW has no idea what else may have been modified (vanos position, redline, timing, fueling, knock retardation) and would surely make for a slippery slope as you said.

I guess I'm screwed, I've hit hear 180 with this thing

190mph was in Ferrari 355 race setup on Poconos Raceway
..hit 182mph in a Stock Porshe Turbo that day too..

and the 600RR was on Ocean Parkway, LI-NY
(i believe its a 35mph speedlimit the whole way now, yet 22 mile straightaway, never traffic)

and these are all according to the speedometer..
Which i know has big % errors at those speeds, but they gotta be semi-close..
