Unreasonable Noise from Exhaust Ticket? Advice?
Last night I went out with the girlfriend to go to dinner at the view at Marriott Marquis. Upon leaving the parking garage and turning into times square i heard someone yelling "pull the vehicle over right now!" so I looked around to see what was going on and it was two cops running at my car lol
So in the middle of times square i got a pink summons ticket, my first ticket ever in the m3, saying unreasonable noise from exhaust, violation 24-236A. I asked the officer if I could plead guilty and pay online, but there's no number or website on this summons. Anyone have a similar experience with getting pulled over and given a ticket in NYC? I live in NJ and i feel like it's much more of a hassle to go all the way to the city to pay for this and I should be able to just pay for it online. In NY a pink ticket is a criminal summons..a yellow ticket is traffic violation.
You have to go to criminal court for that. Rookies on the street..they dont even have patrol cars..I have been going to NY for years and see them stopping people as they walk all the time..but have never heard of a pink ticket given for exhaust.. Welcome to the new Time Square. |

§24-236 Motor vehicles. (a) Motor vehicles, other than motorcycles, with a
maximum gross weight of 10,000 lbs. or less. No person shall cause or permit any motor vehicle, other than a motorcycle, with a maximum gross weight of 10,000 lbs. or less to operate on a public right-of-way where the muffler or exhaust generates a sound that is plainly audible to another individual at a distance of 150 feet or more from the motor vehicle. I have an agency power exhaust with the resonators removed so it's quite literally a straight pipe. If i reverted to stock and went to court would I be able to fight it?

Nope..this is not a fix it ticket, as I said this a criminal ticket..you have to go to Manhattan criminal court, violations section. The date for you to appear is on the ticket.

Did they do some kind of decibel reading? I can't imagine this will stick as a criminal offense based solely on the highly trained ears of two beat cops in Times Square.

During my career as a police officer I had no hesitation writing loud exhaust tickets. Without exaggeration I wrote hundreds of loud exhaust tickets to motorcyclists, particularly Harley riders. Never had a problem getting convictions in court.

just make sure you go to court for that ticket. i got the same ticket and forgot about and a warrant was issue. so the next time i got stopped i got arrested until the following day for my court appearance. the judge laughed a little a dismissed the ticket. but to help you out a little just try to find someone from a shop to issue you a receipt stating that you fixed the exhaust. or you could just pay the $40 fine, but to do that you must go to criminal court. sucks right.
