It's because California wants to use the oem air box with the oem air filter that has a charcoal filter in it. It's easy to do when you have a roots style manifold blower like magnacharger, but not with a centrifugal blower when it takes up that space. No one makes a roots style for the m3 because the throttle bodies connect to the manifold with hose clamps. Those clamps are not strong enough to keep the plenum from being pulled down by belt tension.

As soon as these cars start requiring smog, I think there will be enough incentive to get the certification done.

It's likely it will never happen. The costs and efforts involved to get units certified generally outweigh any benefit to the company to get it done. People are obviously willing to buy regardless of certification. Just cause these cars aren't required to get smog tested yet doesn't mean it's legal to run any parts you want on them until it's required.
