This sucks.

It has happened to me before.
Before we settled on a trade price for my 330i the dealer (Riverside BMW)
they pointed out all these prolems with the car, completely low balling me.
After the deal was done, the stealer had the audacy to take me back to my
trade car and tell me that it was a showroom car and they would make a big
profit on it.
That got me furious, but I had to turn my back and move on...

i would definitely raise hell on the dealership on the fact that they told you you couldnt cpo it and now they are selling it at cpo. you got ripped off a few grand below the book value so at least give them a few headaches

Why do you guys go to BMW dealers to get an offer. They're almost always the lowest.
Carmax dos much better. I know a sales guy at a BMW dealer who brought his car to Carmax when he wanted to get rid if it.

Let me get this straight... You are swapping out parts designed by some of the top engineers in the world because some guys sponsored by a company told you it's "better??" But when you ask the same guy about tracking, "oh no, I have a kid now" or "I just detailed my car." or "i just got new tires."

you get mad for taking what they offered you? and they were offering significantly more money than others? Big deal that they are "selling" it for 54k, they won't come close to that figure anyways. That sounds like a reasonable figure you got for your car anyways,

how long will it take the dealer to sell the car?they must be makin payments on the car while it sits there.
the retail value of the car is around $45k and usually those cars would sits a couple of months especially in the middle of the winter.

Don't be an ingrat,they gave you a good deal.

+1 When I was trading in my 335xi for my M3 last year, Carmax was the only way I got my dealer's lowball trade-in offer up. They gave an estimate when I did the ED order, so when I walked in with a much higher Carmax offer, they basically offered Carmax minus tax savings (which I'd lose going to Carmax). We were so pissed they wouldn't offer even a little more, we almost still took it to Carmax out of spite.

The OPs situation reminds me a bit of what happened trading in our 1 year old Mini (a Checkmate special edition, available only 1 year) a few years ago. The dealer lowballed a bit, but IIRC, matched the carmax offer we brought in. My wife saw the dealer's ad a few weeks later, and they were asking more than we'd paid for it new. We felt we got a fair offer, but seeing it listed for more than new price was worth at least a chuckle.

Those numbers sound about right. I was working with a local dealer on a 2010 E90 M3 with 11k miles. They listed at $59k, but I had them down to high $40's-until some guy walked in with his own lube and purchased it 20 minutes before my finalization meeting.
