The Ministry of the Attorney General says it still views Ontario's street racing law as constitutional, despite a provincial court ruling in Newmarket last week.

On Friday, A Newmarket judge dismissed stunt driving charges against an 18-year-old woman who had been caught doing 157 km/h on Highway 407 north of Toronto.

Fifty kilometres an hour over the posted speed limit is considered street racing or stunt driving under the law introduced in 2007.

Justice Peter West ruled that having a potential penalty of up to six months in jail violates the Charter of Rights and Freedoms because the law does not allow the accused to present a defence.

It's the second time a provincial court has struck down the law as unconstitutional, and the first case is scheduled to be heard by the Court of Appeal in the new year.

The Attorney General's Ministry said in an email that its position is that "the street racing provisions are constitutional and they are an important public safety initiative."

This is a cash cow for the Government and it won't be easy to take it away.

Speed is not really an issue. Germany has less road deaths than Canada (per driver, per driven km) and 75% of the Autobahn is unrestricted.

i cant believe ontario legislators actually passed a BS law like this...

basically allowing a cop to be judge,jury and executioner on the side of the highway...

if i became a cop and i dont like someone, i can pull him over and take his car away right away and leave him on the side of the freeway with a 10k fine and he cant do shit to me. thats just ridiculous.

Most of the time it's not "speed" that kills, it's lack of driving skill that kills. People are dying even at 60km/hr
Obviously if people don't realize that going faster than 60km/hr in a civic is dangerous then doesn't matter what law they put in it won't save anyone hehe

This was a photo of us cruising along the Autobahn just outside of Munich last month in an E92 M3.

Speeding doesn't cause accidents. Careless driving does. People don't take driving seriously enough on this side of the ocean. Everyone over there obeys the rules of the road and no one hogs the passing lane.

It also costs around $1500.00 to get a drivers license over there!!

yeah exactly.. careless drivers kill people .. speeders are just looking for an adrenaline rush! lol

They are working on it! Daily i get calls for people who have been charged or summon with this offence! Ever single one of them hates the charge but it affects everyone!

From news and stuff that i read members of parliments have stepped in to make a change to this charge

Speeding is just speeding excessive speeding isnt stunt driving!

You cant even overtake anyone on the highway anymore without check the spedo twice.
