Yes, I think his point is they would have to prove that it does by putting them in that mode. That, if the system is designed correctly, could be the saftey net.

There is no law against radar detectors in WA.
There is many reasons why they wouldn't be able to get a reading. They would need to find evidence to charge you, you are correct that traffic laws have a revers burden of proof, but the threat of litigation for harassment would be sufficient for them to at least make sure there is something that would cause the error before fining you. Unless you are an idiot of course, in which case you will likely get done for everything under the sun, and probably deserve it as well. Quote:
