Exclamation Lemon Law...

In May of 2011 I went out and got a e90, shortly after i was on this forum complaining about how there was some sort of mechanical error and he engine was replaced under 500 miles, shortly after i had the car for a full year, i got the same exact message a few months ago, car wouldnt drive and again was flat bedded into the nearest dealership, they were unable to figure out what went wrong although the computer did show them there was an issue. I got the car back and it was running like new again. that was strike number 2. just before hurricane sandy hit the east coast last weekend i noticed i had a coolant leak, and again, the M went to the dealer for repair. now at the end of the day i understand that there are bound to be some problems seeing as how it is afterall a machine, so ive kept a cool head about it all and let the warranty take care of everything. im telling you all this story because i am curious to see if you all think i should use the lemon law to get out of this problematic vehicle. thoughts anyone? id love to hear everyones input or experiences with a situation like this.

I don't think you can lemon it for one major issue that happened over a year ago. Maybe if the engine had to be replaced twice... A coolant leak on a one and a half year old vehicle isn't anything major, and was probably induced by the engine work (a hose not being tightened or something).

Lemon law is different in every state, so you will need to search the criteria for your state. You can't just lemon law a car because its had a bunch of problems... example: down here in Florida, to lemon law, it has to have been a certain number of days at your service center or three repair attepmts at the same issue.

i have recently spoken to a LL laywer in my state and it came to be 3 or more times in the shop and/or a certain number of days combined. so i am elegable but i just wanted to see what people on here thought of the situation ie: "fuck it ill get a new car" or "ill just deal with it because its no $$ out of pocket."

What does the this get you if you succeed? Does BMW buy it back at book value, or do they replace it? It sounds like you are eligible, but I'd want to know that the end result is not just them taking the car (and any amount owed) away.

What's the law in your state? Will they make you whole?

i will have to call up again and get all the details as far as my options are considered, but it is something along the lines of: #1 - they give me a new car and i keep paying as if nothing happened. #2 - they take the car back and give me all my payments back. there was a number 3 but i honestly forgot it and dont want to give wrong info.

Honestly, If I were you I would just opt out and get a new car. It seems like you have already made up your mind (as would I) that this is going to be a "problem car." Since I absolutely love my M, I would opt for the option of just getting a new car, though It would mean a few months wait time if you are ordering. I wouldnt take one off the lot unless it was exactlly how I wanted it and I would assume that all payments while the car is not in my possession will be covered by BMW.

The first option sounds good to me. Replace with a brand new M and apply all payments, terms , and conditions made to the new. Essentially giving you a brand new car with out costing of a single penny more, but benefitting you for your trouble of a new car with a new warranty. That is where I would concentrate my efforts. Though option 2 sounds good also.
