please do let me know where in the constitution it covers vehicle engine diagnostics software recording abuse.

i'm glad bmw does this, because by eliminating false warranty claims (like the original post) bmw can offer a reasonably priced car with a great warranty.
LOL. You are right buddy...let's let anyone tie products and services to monitoring of your behavior. That isn't a slippery slope at all!

How about constantly changes ToS to suit the company selling a service to the disadvantage of the customer? After all, that is *just* some video game or online service?

its not tracking where you are going, or anything else personal. the system is simply monitoring vehicle functions for diagnostics.
i wouldn't mind because it keeps costs down when bmw doesn't have to deal with BS claims if someone ignorantly breaks their car and wants bmw to eat the bill for it.

How you are driving is personal; especially when the data could potentially be incriminating as well depending on the circumstances.

So spy on everyone because there are a few dishonest people? Sorry, don't like it; and there is nothing to stop them from doing more and more monitoring.

Right now it tracks engine mileage at the time of "events" as designated by the manufacturer. Without regulation, there is nothing to stop them from doing more, such as adding GPS data, adding even more "events", etc. Most people don't even know the data is being recorded.
