Rear ended twice in 3 weeks...

So I had a pretty terrible few weeks in my E90 M3.

back in August I was just leaving the barber shop with my two kids in the back and my dad in the front seat on teh way to go go-karting. stopped at an intersection about 6 cars back and stopped for a while... some 50+ year old woman smashed into the back of me and pushed me into the car ahead...

kids were fine, nothing broken on my dad or I. I got out, FURIOUS!!!, and started yelling at the woman but saw that her airbags went off and that she was in pretty rough shape so I cooled it a bit.

Ambulance, police, street shut down blah blah blah... doesnt look like much damage below... pretty much just 2 bumpers and some work on the trunk but in an M3 it adds up to $17k. All pics are cell phone pics from the scene.

So the car is out of commission at Budds Collision (BMW certified) for a few weeks. I go pick it up this past tuesday... car looks awesome... all the paint chips etc. in the bumper and hood are gone with the fresh paint, i have a new Dinan exhaust, things are cool...

I drive it home and like 5 minutes later on the QEW i'm stopped again in traffic... and a 40+ year old Vietnamese guy in a Ford Edge smashes into the back of me and pushes me into the car ahead of me... I HAVE ONLY HAD THE CAR BACK FOR 5 MINUTES!!!!!!!!

It's a bit harder than before... carbon grills gone, hood buckled and the trunk is hit harder than before... will need to be replaced this time... total isn't in yet but it's around $25k this time with the extra parts.

being that we were on the QEW we had 4 tow trucks on scene before the police and I had quite the argument with one of them that wanted to hook my car... this time I went off the handle a bit on the driver and the tow truck guy. The police heard over the radio and had to calm me down. This was rush hour on the highway and we were in the passing lane.

Cannot believe it and neither could anyone I called from the scene (body shop owner, manager, wife, colleagues that called me while i was there).







an hour later and I'm right back at Budd's again... no ETA on when repairs will be completed. Needless to say, bye bye resale value... have to mile-out the car now

The car is pretty solid though... my air bags didnt go off either time and to be honest the impact wasn't that bad even though i'm whip-lashed hard... heck i was still feeling like shit from the previous accident and now i have another identical one. None of the lights were damaged in either case as well... makes me feel pretty confident about the safety of the car.

I don't want to hear any of this "at least your safe" crap either... a car like this isn't just a car and according to insurers it's probably worth more than a lost limb or lost vision so let's all feel terrible for a moment please. And now the resale / trade-in value on the car is wiped out completely with two claims like this in such a short period of time.

Oh wells... car is still in warranty and i'll grab the extended warranty and get what enjoyment i can out of it... It will be worth more in parts by the time i'm through with it. I was hoping to trade it in on an F30 M3 but that likely wont happen now.

As requested, I'm not going to sugarcoat..That's pretty messed up and I feel terrible for you!
You have the worst luck ever and I'm really sorry about that.

I've been in a similar accident situation (but not twice in a row, sheesh) where a guy rammed me from the back at a very high speed, while I was at a stop at a traffic light. I kept on holding my brakes in and so I moved not far into the cross-traffic area. Luckily nobody was passing at that instance. I've learnt from that experience that BMWs are such solid cars. One thing I should mention is that I only found out after the accident that the airbags are not deployed when rear-ended, no matter the force of impact. I was told that seat-belts are sufficient to keep you in place in that instance. But I would have expected for your airbags to have deployed since you hit a car in front of you.

I hope everything works out for you and that you get a decent resale value for yours (mine was pretty good even though the entire back end of the car was unrecognizable). Let's hope that the E90 M3 becomes highly valuable soon!

That is bad luck! Over the years I've come to the realization that driving is a 100% time consuming task. Anything less than 100% and your odds of an accident go up significantly. Did any of the rear-enders have a cell phone in hand when the crash occurred?

I would be pissed off the charts as well if I was in your situation. Sounds like a good starting point for being a weekend track car though.

Push your insurance to get the car written off.You do not want a car that has major accident repairs.If they will not write it off then push them for a settlement on accelerated depreciation.I deal with this everyday and reselling a higher end vehicle with accident damage as reported by Carproof is a big hit to the pockitbook down the road.Especially when it is a not at fault incidents.

I bought my M3 with over 10k in repairs from a hail storm. Everything was repaired professionally, the trunk and panels were PDR'd and the hood was replaced - can't even tell there was anything wrong with it. Other then that the car is perfect mechanically. If you were to resell the vehicle with all repairs listed, a true enthusiast won't care about some cosmetic damage, I sure as hell didn't.

Rear ended wont be considered cosmetic... especially since pictures do not follow up the carproof the extent of repairs is not known and the worst is assumed. I'd do as Gearhead said.

I'm sorry to hear about your luck. I feel for you. It sucks when bad things happen to your car due to the negligence of others. Thankfully nobody was hurt in either instance.

Sadly, you won't be able to get another new E90 M3.

I just got rear ended this weekend. I was stopped at a red light and a car hit me from behind and pushed me into a pickup truck in front of me. Took my front plate right off and caused some damage to my front bumper as I went under the rear bumper of the pickup. The woman in the car that hit me was driving a crappy 15+ yr old Ford Escort. She got out of her car blubbering "OH! I'M SO SORRY! IT'S MY FIRST ACCIDENT!" while the guy in the pickup started ripping her a new one. The guy in the pickup started back to his vehicle to get his license, registration and insurance when the lady looked at the back of my wife's Odyssey and remarked, 'Oh, there's no damage', though there clearly was and she didn't even look at the front of the Odyssey and said 'Thank you!' got in her car and drove off!

Neither of us could believe what had just happened but we both managed to keep our wits about us enough to get her plate number.

Got an email from the Police Officer who came to the scene saying that they had contacted the woman who owned the car and that they would be talking to her this evening.

Good luck with your car. Hope everything gets sorted out to your satisfaction.

Very sorry to hear about your loss. No insurance can replace the waste of time and overall dealing with something like this twice. I agree with Duncan that you should push the insurance company to write the vehicle off.

Hey OP -- Shouldn't you be filing 2 individual lawsuits right about now? You've got 2 perfect zero-fault rear-end collisions, loads of pics, police reports, etc... You may be driving a brand new F10 M5 or better by the time you're done!

Canada's legal system works much differently than the US one and it's way tighter than Florida's for sure. Basically there isnt much i can do right now. I'll have to revisit it next year.

Canada, outside BC, has no precedent for diminished value claims and reputable law firms will not take those kinds of cases unless there is a AB claim or various other compensable losses attached to it.

The car is at a BMW certified collision repair shop, arguably the best in Canada, and it's getting the VIP treatment so i wont have an issue with the repaired car. The damage on the second accident was still non-structural so it didnt get up near the total loss-threshold.

It's just as well. Even if i got the $ for a totalled car the cost of switching over the mods onto another M3 would have eaten up any of the gains i could have made anyways. At the end of the day i just want to drive the car.

Not soliciting sympathy or advice here. All is well in hand. I am simply putting the info / pics out there for discussion purposes. If i do sell the car I have a reputation for being a legit seller so it's not like i would have or even could have hidden this from any potential buyer anyways.
