Engine Malfunction warning

Just came back from the stealership to get a new Comfort Access key programmed to my car. It cost $159 for programming CA and $258 for the key itself. I know, that's a ridiculous amount of money to pay for 1 key fob.

After getting my car back, the service advisor mentioned that I had some "faults" since they also did a service inspection. They said the thermostat, vanos exhaust bank #1 and intake temp sensor had triggered a fault but the check engine light never came on. However, I did not mention that recently during cold starts in the morning the car will go into limp mode with a engine malfunction warning and after I turn it off and back on the engine malfunction warning will go away.

Can I get some feedback if this might be due to a failing throttle actuator? Or could this be some other issue I should be worried about?

The dealer did not provide me with any codes. All I got from them was this on my invoice.

I believe the actuators are covered under emissions warranty in California for 7 years, 70k miles.

I guess it depends when the car was purchased. You're right at 7 years.....

There is also a Federal 8yr/80k emission warranty too.

Thanks guys, I just brought my car over to MRF engineering and Malek mentioned that my thermostat was going bad, causing those other codes.

However, I will be doing some research and calling around to see if BMW can replace my TA under that emissions warranty.
