I mean, do you think you could take oil analysis to the dealer and get a rod bearing replacement done under warranty? I don't.

Sooooo.... I wouldn't bet on it.

Maybe? Maybe not?

I'm not the judge. But obviously he/she saw enough evidence to make BMW prove otherwise at this point.

No need to get hasty bud. It's just the internet...

Can you please clarify your situation ?
Did you heard something (rod knock) or loud ticking noises before the bearing failure , ect... ?
How many miles ? Build year ?

Damnit . I'm so sorry man !

Phillipe have you reached out Paul Scarlato the lawyer involved in the class action? If members are willing to speak with him they can be part of the class. This seems like a great way to create awareness and let people no longer deep in bearings know they should call him.

No , I have not . I thought it was for American S65 owners only , because the class action is in the US ?

On the other hand .In the last 2 years I saw several threads about class actions , and I never believed it would be effective .
Knowing what BMW is , they have an army of lawyers ..

Here is one of the threads from 2015 => *Class Action Lawsuit for Rod Bearing issue, LETS FINALLY DO THIS* => http://www.m3post.com/forums/showthread.php?t=1126924

It is for the USA only and seems to have gotten traction in the courts. I have spoken with numerous shops and the lawyers as well and they are aggressively working it. Considering the number of worn bearings I have seen pop up just in the month or so I have been on the forums it seems like there are a lot of people out there.

Every instance of an issue made part of the class action will bolster the odds of a win/settlement. I'll see what they say when I speak to them Monday. It may be worth sending out some PMs to those you have on your list.

Ok , I see . And let us hope..

If only everyone would be involved in the class action , knowing that more than 60% + of the owners NOT mentioning about their S65 bearing failure because most people think about the value of their car..even when they are on Bimmerpost .
Think that's actually a logic reaction..

Probably the rest of the world don't give a 5H1T about Bimmerpost or bearing failure and just dump the car ...

I'm pretty sure *NO ONE* knows the real current % of S65 bearing failures , because they are all over the world ( the problem is worldwide)
One thing is for sure...The % number of bearing failures is bigger than we can imagine.

I still can not believe some people say it's only Internet hysteria...

Phil, this is a very good idea in my view. Boosting whatever case there is and make some use of your list buddy.

Cheers

Currently *138 bearing failures* on the Bimmerpost list alone.. !

The worldwide number is easily X 3 ... ( no one knows it for sure )

Assuming three times your number as you've mentioned and the total worldwide production numbers of 57,627 (per the PDF in this forum)... That means 0.7% of the vehicles made have had a failure. Catastrophic failure? Yes. HUGE issue? Doesn't appear so...?

I haven't read the entirety of this thread, but is the 138 number representative of actual failures or does this include people that have changed out their bearings as a preventative measure and found that their bearings were pretty toast and death was on the horizon?

I ask sincerely. I'm on the list of people on the fence of changing them out with BE for preventative measure...
