Did you have your differential fluid changed at your 1200 mile service? I had that problem initially and when I took it back my SA mentioned that there was a TSB about what kind of fluid to use and when they put the other stuff back in it fixed the problem. I think I recall a thread about this but I'm not sure. I submitted a complaint as well about the lag.... |

How many of you have actually register this problem to the NHTSA?
Let the government force them to fix this. https://www-odi.nhtsa.dot.gov/ivoq/Consumer.cfm PLEASE INCLUDE YOUR VIN# or it's meaninglss, per Radiation Joe. Thanks. It only takes 5 minutes to file a complaint. If they get a few hundred complaints, then they make take a look at this. They're the reason we go the first fix, otherwise, I'm sure BMW would have called no downshifts during braking, "a design characteristic and normal behavior for the M DCT transmission."

Let me get this straight... You are swapping out parts designed by some of the top engineers in the world because some guys sponsored by a company told you it's "better??" But when you ask the same guy about tracking, "oh no, I have a kid now" or "I just detailed my car." or "i just got new tires."

WOW! A DOT Response
Just had this come through on email:
Dear BMW Owners, My name is Emily Reichard and I am an investigator with the National Highway Traffic Safety Administration of the US Department of Transportation. I am interested in the report you filed with us regarding your 2008 BMW M3 transmission. Can you describe to me what happened when you were driving the vehicle and the specifics of the event (i.e. where, when, at what speeds, how often, etc.)? Did any warning lights or noises occur when this happened? Did the problem ever place you in any unsafe or dangerous situations? If you saw a dealer, what was their remedy for solving the problem and do you find that it worked? Have you been notified of the DCT reprogramming as stated in Recall #08V-595? If so, was it performed and has this remedied the problem? Any other pertinent information regarding this would be greatly appreciated. Thank you for your time and have a great day. Emily Reichard Assistant Investigator, US D.O.T. National Highway Traffic Safety Administration |

I would like to speak with that complete idiot I spoke to at BMW customer relations again .. a senior manager ... that assured me that what I (and everyone else was experiencing) was completely normal behaviour. |

It's probably an obvious thing to suggest, but please, when responding to Ms. Reichard, provide the URL to this thread so she recognizes how widespread this issue is.

I just got the email as well. I am glad somebody is looking into this! I will have to prepare a detailed response to accurately reflect the issues.

I too got the e-mail. Responded with the link to here and to the law-firm class action web site that was previously posted.
Thanks for all your support to those who commented. Should we forward that e-mail we got to someone at BMW? |

Got and replied to the NHTSA letter. I'll have to say I am surprised it made enough of a blip on their very large "radar screen" to warrant the letter.

You're probably right, but, you know, you never know.
There's a light near our office that got redlight camera's a few months back. About the same time the lights started screwing up and cycling every other time in about 4-seconds, backing traffic for blocks. My partner and I went through that intersection for months and always commented about the lights and surely the cops were reporting it to the city and we wondered how many redlight tickets must be disputed in court. Finally last week we called and got a traffic engineer that actually called us back to say that yes there was a problem at that intersection. Guess what, today it's fixed. It's hard to believe that no one complained before us, but that seems to be the case. Dave

You would only get a reply if you reported the issue at the NHTSA web site as discussed earlier in this thread. Even then, you might not get the request others did.
