OP, sorry to hear about your troubles on a brand new car. I'm going to assume they are going to at least give you an extended warranty on the engine? That's what I'd try to work out with them.

The car sounded awful in the video.

Uh oh. So what was the fix? Under warranty?
I didn't think of asking for an extended warranty on the engine. I was going to see if I could get my payment dor the month of Jan. reduced two a two week payment if they do end up having my car for two weeks. I still haven't heard anything back from the dealer. I'll definitely will keep you guys posted.

MIght be worth asking. That's worth way more than 1 month payment, especially if you plan to keep the car for a while.

If it were me, I'd be looking for BMW to replace the vehicle....no negotiations.

Update:

I talked to my SA today and she said that they still haven't found the problem and are going through the PUMA process. They have taking pictures of the valve springs and valves to send back to BMWNA to help them diagnose the problem. No definitive answer of the problem. Oh and the engine is officially out of the car! Why they had to take it out I don't know but I have read another thread here with about a member who had a valve spring problem and they didn't have to take the engine out. Obviously I'm not an expert though.

Tell them to slip a stroked Dinan motor in when they drop the motor back in.

Seriously tho, sorry about the bad luck, but I'm sure BMW will make it right. In the meantime at least you have a nice loaner.

I like where your heads at! Yeah like the 7 series but obviously would rather have my M. It is surprisingly quick for a big car!

So do they suspect the valves? if they went through the task of pulling the engine I would be worried they suspect the problem is deeper in the engine.

Im guessing yes but, they haven't given me a definitive answer yet. I don't think they know what the hell the problem is. The car went in 1/7/13 the engine was taking out 1/10/13 according to this time frame they have had four days to break the engine down and diagnose the problem. Im willing to bet they will have the car all next week. Very frustrating to not have any answers yet!

Lemon laws vary by state. You can't just walk in to a dealership and ask them for a whole new car off the bat. Side note, I hope you get your car together in one piece.

I'd second the idea of asking for extended warranty. It is definitely better than a month's payment unless you're leasing the car and you turn it in before warranty ends. :P

Update

My car is still at the dealer and I still haven't heard anything back about what might be wrong. I am going to make a trip to the dealership tomorrow and talk to the tech and see if he can tell me anything. I also want to take some pictures to keep around in case I need them. On a more positive note I got a phone call from a gentleman BWMNA to see if there was anything they could do for me. I asked for compensation for the time I didn't have the car and an extended powertrain warranty.

They should easily accommodate your wants. At this point it is obvious that none of this is your fault.

Keep us posted man! Hope it all works out for the better.

If you get lemon law status (which is incredibly hard and a PITA), ask for a lime rock E92, FO FREE. And maybe some waffle fries.

I find it incredible that the dealer is not able to at least go over with you a few things they "suspect" may be wrong. My guess is they are being extra cautious as BMW NA is involved and your case is very unusual..hang in there.

It's pretty positive that BMW NA called you to make this right, looks like they're really going to track your progress and work this out to your satisfaction. Sorry to hear this especially with a brand new car, but hey, at least you have the 740i and see how the other side lives

One question, did you have ZERO problems until the 4900+ mile point where the Engine Failure happened?

I would expect or hope BMW NA would just authorize a new S65, drop it in and call it a day. Let them take apart the errant unit on their own time.

I just picked up 2 weeks ago, 300 mi on the car and nothing yet. This scares me though.
Between this and the "Ticking" that some e92 develop after 1200 mi, I'm getting paranoid.

OP sorry to hear, what did BMWNA say about extended warranty/ half monthly payment?

I haven't heard anything back yet. They guy I talked to said he will be in contact with me after I get my car back. I wouldn't worry about this happening. The service manager said out of all the cases in PUMA they only saw one other one like this on an X5
