Further, you may be subject to criminal (or more commonly) civil liabilty...

Since the badguys had no weapons and he easily could have left...deadly force would not have been justified by the evidence in this video...
what are you talking about? i never asked if he could fire at the guys, i asked if he could fire a shot into the air to say 'don't fuck with me' and make them back off

What we are trying to say is that in the video that was posted, pulling out a firearm was BY NO MEANS justified. That guy was NOT in serious danger of bodily harm or death as he could easily driven past those guys in his car.

None of the drunks in the video appeared to be armed.

The guy with the bat stopped his car and deliberately picked a fight with them.

Drawing a firearm and firing off a warning shot against an unarmed group of guys who you picked a fight with ultimately is a criminal act.

Hope this helps.

When you're under the influence of some sort, you have 'super human strength' because you're not responding/feeling to pain.

I asked myself that question a couple of times because the sound of the bat cracking was just too brutal.

I was thinking the same thing.

They kept coming back for more.

That's when the guy with the bat knew he was in too deep.

he wasn't swinging hard enough.. they didn't go down to the ground once...

I'm getting a permit soon to carry 2 retractable batons (or anything else I want in the car)

I have a bit of informal training with kali sticks.. not the same thing as eskrima sticks, but it'll do

Tom Cruise played one epic Mofo in that movie. There's also an epic shootout at the techno club later where he needs to eliminate that asian witness. Only dissapointment in the movie is the ending. No way a professional killer would let that happen.

It sucks that he lost the bat, it would have been great to see him pounding those dumb drunk morons in the face with that bat over and over again. People like that deserve to be run over, shot, beaten, and whatever else you want to put in here.

I would have 100% run them over, shot at them, tazed them, violently hurt and beat them if I was in real danger for my life.

But the smart thing to do is just drive away and not deal with such vermin.

The problem is the driver should be charged with assault. Not that what the drunks did was right but the driver was away from the situation and came back with a bat.

Imagine if that stud had some back with a katana or some type of sword instead of a bat? It would have been a scene from Kill Bill.

That would have been epic. Maybe I should put my dad's katana in my trunk?

What would have happened to the bat guy legally if he were to have run 1 or 2 of them over while escaping (during when they were ganging up on his car).

The guy had every means of escape. All he had to do was drive off. Instead he chose to stop his car, got out, and escalated the situation. If he had theoretically shot someone the DA would probably have sent it to a grand jury. Definitely stopped being self defense the minute he got out of his car.

Also, why would you get out of your car and go at people with a bat? Just run the assholes over.

Subject with the baseball bat should not have escalated the situation by stopping, leaving the vehicle and brandishing a weapon when the threat had subsided.

If subject was in Colorado and was simultaneously confronted by multiple threats, subject would have full right to protect himself, especially if he had a firearm in his vehicle. Current Colorado statue C.R.S. 18-12-105(2): "... allows a person to carry (without a CCW) a firearm in a vehicle, loaded or unloaded (loaded = handguns - both semiauto and revolver, unloaded - long guns), if its use is for lawful protection of such person or another's person or property."

This CO law may be vague, but considering multiple threats with possible unknown weapons towards person/property, the use (i.e. presentation, ready-position, etc.) of a firearm would be justified.

I'm unsure about MA, for firearm laws will most probably be different from CO.
