I think the key to his problem and I'm just guessing is that if it's not a "clean" title then the value of the car will take a hit on trade in or private sale. And if that's the case then that would be a serious issue for me. Not to mention that he over paid for the vehicle now. This will be some interesting detective work OP.

Things get posted to carfax months, even years after an accident takes place. I was looking at an E90 who had an accident in 2012 and wasn't reported til 2015. Under the third owner, it noted accident reported x/2012. Minor damage. There's a very good possibility the dealer didn't know. Regardless, try to find out what was damaged. A scratched bumper cover won't effect price on private sale and if someone try's to hustle you on that fact tell them to kick rocks. I'd rather have a car with fresh paint bumper then something chipped up. So there will be someone out there that'll be the same way. Do some digging before jumping the gun

I had this happen with a previous car I had, bought as a non-accident vehicle from a dealership.
Carfax reported an accident over a year later.. I contacted the dealership and got the typical defensive responses. I would advise checking autocheck on top of carfax. It usually reports things like this quicker than Carfax does.

So I basically do a random check at a local paint shop here, without telling the guy which might be involved in an accident. he directly address to me that rear trunk, bumper have been repainted, which is coherent with what the carfax note, "damage to rear".
I am going to the dealer to talk about this, my sales have been evading my calls for the whole day, and only texted me that she was in a meeting.

Not sure how the dealerships work there but the ones here will tell you what body shop they go to or it’s commonly known amongst the bmw enthusiasts locally.
Try to reach out to that body shop and give them the VIN. If they did the repair, they will have an invoice on record to share. |

I checked and ask for the VIn, and they told me the car had rear bumper replaced and it was an insurance claim. It seems odd to me that the fixing was done in a workshop that actually have a little desk and representative in the dealer. And they claim to not know abt it.

Excellent detective work. I'm going to use hypotheticals but it's close enough.
I am going to assume you paid $30,000 for the X5 and it was valued right at market value for a dealer vehicle. And let's assume that trade in was $25,000. Go to a local dealer and ask them what trade in is on your vehicle right now. If they say it's considerably less than $25,000 because of the prior accident then you have clearly paid too much for the vehicle. If it's still at the $25,000 mark then the Carfax entry has not cost you anything. Also ask your dealer how much the trade in is. Again, it's the same scenario. If your dealer throws out a number like $22,000 or even less because of the stigma of the Carfax entry then they will have to look you straight in the face while telling you this. They also have some explaining to do as to why their CPO inspection missed an obvious painted body panel. I would ask to see the original in house inspection for the CPO. Under the circumstances they should supply it. |

Dealer still stating that they did nothing wrong in this transaction. I've tried to reach higher management to talk and resolute the problem, but still waiting for answers. I would like to see what they can do for me in this unfortunate event, as a dealer and bmw.
I complained to bmw usa but I don't think that will do any good either. Basically I am still unhappy on how the staff handled this situation so far, and will open dealer name this week if I heard nothing from them. THank You

Did you get a estimate or fix sheet for the bumper fix? I say if it's under $1000 of damage, let this go.
