when you say free tech inspection...would that count as an inspection 2 for my e46 m3?

Its a 31 point inspection (mostly visual) and diagnostic (GT1)...

ex.
They will answer if you any questions or concerns on your car, put the car on a lift and inspect wheel bearings, bushings, struts, rotors brake pads , shift linkages, sway bar, diff linkage, hoses , belts and connect the car to a BMW diags tool and look for codes, recall info...

Does the car have to be out of warranty? I'd love for them to check out my brakes =)

I dont think so. A 31-point inspection can easily costs you a few hundred bucks even with warranty if you wanna do it in between your scheduled service.
