I don't know. If he didn't hear any major bang noise. It most not be a rod through the block. Possible this dealer over filler with oil. For it to be coming from the top cap. Blow a main seal or something. If the engine cranks over the internals are still good

Mike from bpm PMed me and was so kind to offer me to look up my car's US history. I gave him my VIN and all he could find out was that BMW marked the car as "no coverage, only for recalls" which, he said, was usually only for lemon buybacks or salvage titles.

What confused me a little is that the car was in for a service at Weatherford BMW in Berkeley after the accident. I don't believe the insurance company had it repaired there, since it wouldn't make sense for them to declare the car a total loss then if it could've been repaired. I emailed Weatherford BMW to maybe give me some info on what they did exactly, since all it says is "Vehicle serviced". But I don't think they're gonna give me any info

So the car I bought is an even bigger turd than I thought. I would've never bought it if I knew it had an accident, let alone a total loss! I don't even care about a new engine, I just want my money back for the car. The car isn't even worth that money if it was in an accident.

My lawyer hasn't had time to fully analyze it but he basically said that if it doesn't say anything it's pretty much the same as hiding it. Sounds like a long legal battle.

For what it's worth, US cars can be totaled when the damage exceeds 50% of the value (vs.the 75% you mention), or if the insurance feels the car is no longer safe. Not that this is somehow reassuring to you. Sounds like this is one that wasn't meant to be back on the road. Sorry for your luck, these kind of situations are always such a hassle to try and remedy.

Good for you was that Mike was checking the VIN nr , so the history of your car was very clear , and sad to see that you are 100 % screwed !
Needless to say but always check "FIRST" the VIN nr of the second hand car!
Anyway you have the prove in your hands that the car was totaled,and see you have a lawyer ,but look after a good lawyer
You will need a "good lawyer" because your dealer is a "THIEF" !
But the worst thing is that I saw that your car was imported to the Netherlands , and i'm not so far from the Netherlands and know some places there that have realy....realy bad reputations !
The name of that place is called ...."The camp" their reputation is to put back expensive German sports cars when totalled...total loss back on the streets and messing with tags and ECU from cars also with chassis nr's and vin nr's !
Inside the camp ... the people,(actually the word people for these persons is to nice) they are armed and the police is very often there !(Stolen expensive cars) !
So you are screwed not ones but several times !
I have a lot more info about this ,but can't post it on here !
It's realy damn sad to see from where your car came,and feel realy sorry about your situation ....damn !

My lawyer already typed up a letter and is gonna send the dealership a demand of repayment with a deadline next week. I doubt it, but I really really hope the dealer is gonna go for it.

Hopefully business conduct in Germany is on the up and up because it looks like you just bought yourself a giant mess that's worth well below the $45000USD paid. The motor issue definitely complicates your situation further

??? I looked up the history as a favor to help him track down its previous life once I saw this thread.

Obviously he purchased the car in good faith and did not expect that it was previously damaged and that it had a branded title.

50K damage is speculation, but for it to get a salvage title in 2010, it definitely had a 20K+ repair bill. He didn't knowingly buy a nightmare car.

OP: glad I could help point you in the right direction... although it's not the best news.. I think you have a good chance of the dealer giving you the money back on this. Surely the value of the car was considerably less than you paid. I can't imagine them trying to snake their way out of this one, especially given the cars prior history and current problems. Good luck and let's hope they do the right thing.

not just dealers, private sales too
no offense to anyone. Recently, 2 of my friends both got 2011.5 M3s one from carmax and the other from craigslist, private sale. Both bearings failed after couple months. Carmax had no clue of any bearing problems and the other PSeller said he never tracked nor suped the car but found pictures of his car at willow. Ive met couple guys on the forum that dont admit if they suped their cars in the past, they go back to stock and never a word.. Sad..
