Arrow Speeding Ticket Penalty

So, the unfortunate happened yesterday. Got my first speeding ticket since moving to NY. Caught 91 in 65. (please, no ) I always cruise <80, but my foot got a little heavy (damn sport mode) passing some other cars...

Anyway, what kind of penalty am I look at? I had a clean record. Also how much increase should I expect on my policy?

In addition, I am moving to TX. Will the record be carried over when I get a TX license?

I don't know about the penalty, but where in texas are you moving?

Get your new Texas license NOW, before your ticket hits your NY record. There is a chance that your points won't transfer if you move fast enough.

get a lawyer and fight the ticket. it'll cost you about $200 but the savings in insurance points will be well worth it.

that's a good point, not sure if it is possible unless you have a TX address already though. i got tickets in NY on a CA license and, while I had to pay the fines, it never went on my record or affected my insurance. not sure if that is still the case.

91 in a 65...you're probably looking at 500 bucks.

You didn't specify but I assume you got a court date as opposed to an infraction ticket with an amount that you can pay??

NY is prob different.. but in CT.. plead guilty and pay the ticket = no points. Plead not guilty and you may get a reduced fine but you will get points on your license. Insurance can go up either way for moving violations....depends upon co.

Prior to becoming a cop I got a ticket for 81 in a 65. My insurance co. tried to jack up my rates a year later. Tought me a lesson and made me considerate when giving people tickets.

here in texas, they will find out of state tickets. we run on a point system like most of the rest of the states. one ticket, no big deal, but if you have more than 2, you'll pay what's called a driver's responsibility surcharge (3 years at $105...bastards!) i don't know how NY law works, but try to get deferred adjudication on the speeding ticket. after 3 months, it falls off record and should be done with, having no effect on your driver record. even if you were to get pulled over again, just delay the court date on the new ticket until the old ticket's probationary period is over and do the same thing (deferred) with the new ticket. i've had quite a few tickets over the years but still manage to have a clean insurance driving record, and that's how i've done it!

Ouch!!!!!! This is bad luck. The cop wouldn't give you any break? Having read your post as well as atny286' s unlucky experience, I really need to learn the lesson OR get a V1.

You see 91/65 in busy NY is not Reckless, while 81/65 in Empty Virginia is... (I know). Just get a local lawyer, get your points reduced or whatever, otherwise you will pay your ticket through insurance for the next 36 months!

sounds right. When I was in PA and got a speeding ticket...the infraction was on the ticket...pleaded guilty and paid the fine which was on the ticket. NY is much stricter.....def go fight it though...usually you can get it lowered.

So guys, finally went to the court... plead not guilty and reduced to 75/65. $235 fine. I guess one lesson is to not trust those so-called traffic lawyers. Most of them wanted to charge me $400+ in addition to ~$200 in fine... DIY FTW!

On a side note, the ADA who was in her 20s was gorgeous... So for the future, if you want to speed, go on I-87. Cheers.

the defensive driving course will take points off your license and reduce your insurance. But even after the points get dropped from your license the insurance company doesn't forget about them for 4 years.

In NY if you get 3 or more moving violations within 18 month, your license gets suspended... something to keep in mind ;-)

not really, with a lawyer you probably would have walked away with no points. The deal you got still is a moving violation on your record and points which may lead to an insurance increase. At the end of the day it's just deciding who you want to give your money to (the state, the insurance company, or a lawyer).

PS Also to keep in mind, in NY there is a difference if redueced to no points and moving violation, and can be reduced to no point non-moving violation.
Moving violations in NY may lead to ins increase, and will count to 3 strikes and u r out.

I've called more than 5 lawyers and none of them said they could reduce the violation down to no points/non-moving violation. Most of them said they may get it down to 2 points for a "disobeying traffic signal".

Plus, all of them basically asked me to pay them, and none of them would guarantee any reduction at all, which means I have no leverage what-so-ever. So why would I give money to a stranger and hope that they may do something for me in return?

Remember, this is originally a 91 in 65 six-point violation.

the record WILL move with you. did the cop say reckless driving? in cali anything over 80 = ur fukt

make sure u do traffic school if it's an option before u move

The biggest advantage to using a local traffic lawyer is that they most likely have a friendly relationship with the local prosecutor. Most defense attorneys are prosecutors in other towns top make $$ at both ends. The prosecutor in my court has always been good at offering the best possible deal even if you don't have an attorney, but my court is much more liberal than most.

Also, FYI- NY DMV doesn't really care if NY drivers get point tickets out of state.
