I would STRONGLY suggest the cessation of posts of unsolicited videos, messages, images, and the like that portray any likeness of anyone involved in a negative character light, as such can be used to bolster any potential litigation with character assassination as merit. Ken can and should prevail here, but some here may be unknowingly subjecting themselves to potential litigation. This isn't legal advice, merely an opine from one who is concerned at the direction and tone this has taken, with a minimum of 3 attorneys directly involved and with vested interests for their clients, perusing these forums.

I would tend to agree with you; however, from all accounts by people in the know at the stealership...they are having a kick-a$$ week.

So, therefore, no damages to recover...but I also am not a lawyer...

I too have been a BMWCCA member for a very long time about 20 years minus a 2 year hiatus in the middle for college. I read the Roundel from the moment it arrives cover to cover. I am the one who posted on our Forum at BWMCCA about this. I like the idea that you are giving your $.02 to this situation, but I am uncofmortable that you are using your "president" status as your signature. For all the readers here, he is not representing BMWCCA and nor am I. You intentions might have been to be unbiased and share information with all of us, but your post was clearly supporting the dealer. Have you spoken to Dooma to get both sides of the story?

I contacted Dooma on day one to invite him to our LA chapter. I hope he joins. Southbay BMW is Awesome and will take good care of him.

Not really sure what "rectitude" means, even with a college education!!! LOL..

I am certainly NOT SO STUPID as to think there haven't been some people that have had bad dealings, or raw deals, at BMW of Lincoln. Some of them are posting now. But for 4-5 people, some past employees who are scorn and possibly rightfully so, is just not a huge number in my mind. Are there others out there, probably yes. But there are almost 1 million hits here....only 5 people!!!! Ok...give them 10 people pissed off then.... I would say I agree that there is probably at any given time of the day, a customer at one of the 368 US BMW Centers that is getting a raw one. My job is not to defend the Dealership. That is not what I was doing. I had some information that NO ONE had, many were asking for and I was quiet about it for about a week. I had many members contact me but were afraid to say anything because anyone posting ANYTHING positive was completely blasted, called a troll and personally attacked.

I appreciate you recognizing the ammount of work it takes to build a membership base that started out at only 113 members into something that is now hovering steadily around 400-500 with many events, at least one a month. I have great people around me and would never accept praise for doing this myself. Some of the best people I know are members of the club and I am proud to call them friends.....

Scam #5: The "Your Online Lender Bounces Checks" Scam

How the scam works: The dealer sees your bank draft from a credit union, or online car finance sites such as Capital One Auto Finance, HSBC Auto Finance or AutoCreditFinders. Not wanting to lose the extra gravy of selling you the car dealer's RISC financing, they refuse your bank draft, lying to you that "online lenders bounce checks." They will say "their checks always bounce, so we don't take them". But gee, the dealer is willing to provide you financing, at higher APR. CapitalOne and HSBC are household names and many car buyers already doubt the salesperson's lies. So they may also tell you "well, they take too long to pay us".

Some salespeople stop at nothing. If your lender was bouncing checks, we'd hear about it via federal investigations. I get daily emails from people who financed with Capital One Auto Finance, HSBC Auto Finance with no problem. I used Capital One Auto Financeto finance my new 2004 Lexus GX470 SUV. Lexus had no problems accepting my CapitalOne check. My friend financed 2 used cars with Capital One Auto Finance. There's nothing wrong with dealer financing if they can beat your best APR. If not, use your online financing. Unless you qualify for a manufacturer's 2.9% financing, online banks will beat the local banks used by dealers most of the time, and online lenders often beat credit union rates. If a dealer spews out this scam and refuses your online financing, you the customer need to retain control and refuse to buy from that unethical and slanderous dealer. There are plenty of ethical dealers who eagerly accept online loans without the lies.

How To Avoid The Scam: Tell the finance manager you're onto their scam, online lenders have been in business for years and fund loans without bouncing checks. Then get up to leave. You should also file a complaint with your state Attorney General's Office, because we need to make this scam illegal for dealers who force you into higher APR financing. I get emails on this scam often, and if the state attorneys do not know this is going on, they can't help us consumers. The federal government should wrap this into the Truth In Lending Act. I had a friend use either CapOne or Eloan many years ago to buy his Diablo Roadster. The dealer had no problem taking that check!

the long it drags out the worse it gets for them. now, there's even MORE reason to investigate their illegal practices. they want to recoup their losses, by trying to trick him into signing the price $60k, but with their financing, which they will try to hook him with an OUTRAGEOUS interest rate. sneaky SOB's.!

Actually, I thought it was pretty funny in layout. The cheesy voiceover sounds like the girls voice on my Garmin GPS...LOL.... The message conveyed, as you can imagine, is NOT the treatment I have received at the dealership. I am sure others feel they have gotten that treatment and that is their story to tell. I do think it will be remembered, while not with any special effects awards or anything. I cannot speak for anyone at the dealership other than they said they were getting "beat up", especially Fil....

I would strongly suggest you provide proof of funds to these A-holes ASAP, exactly what was provided to the dealership so they can see it because clearly the dealer is probably lying to their own firm.

Also, there is no way for Ken to back on every internet forum and post something else to "retract". The first time he begins something like that, it will not be enough for them, they will want more and more and more. I say stick to the guns and buy the damn car.

Also, to whom did BMW of Lincoln offer to pay for the flight or the car transportation to Cali? Ken, were you called directly? Scott, did Maledon say so? I don't even buy that.

personally, i think they're trying to stall or prod the fire hoping for a technicality to get off the blame. DON"T DO IT KEN !! its stall after stall, then trying to pass the blame onto you. "sure we'll complete the deal" (i'm the good guy) "you can't even afford it !" (cast doubt onto you, you bad, they good). now, "we still want to complete deal" (we STILL good, and trying to be helpful), but "you paying with invalid mean" (you're bad guy). i say advance legally to OFFICIALLY put them on the spot even more so. enough is enough. they're obviously trying to get you frustrated to commit an error. in a sense, they've got your car hostage. and when you're trying to pay ransom, they're upping the ante. BOGUS !! advance legally, so its not just a closed door privately b/w 2 parties. let the world know what a piece a work these guys (Van Tuyl / husker auto). i'm sure nebraska wouldn't want to be associated with them (NCAA always investigating business relationships with universities).

While Husker does not intend to suggest that Mr. Tanisaka does not have the financial wherewithal to consummate this transaction, any inferences that Husker has been delaying his consummation of the transaction are entirely unfounded. In fact, Mr. Tanisaka has routinely been dealing very cooperatively with Husker’s sales manager and has been very complementary toward him. Another unreported fact is that, as a gesture of goodwill, Husker offered to pay to fly Mr. Tanisaka to Lincoln to take delivery of the vehicle, and also offered to pay the costs associated with shipping the vehicle in a covered truck from Lincoln to California.

Husker does not seek to silence or in any way limit the rights of those who wish to express their opinions on this now widely publicized ordeal. But based on several reckless distortions and omissions of fact, the dealership and its employees have been grossly mischaracterized. Husker acknowledges and commends the comments posted by Mr. Tanisaka, his attorney, and the many others that have requested the personal attacks to cease. Husker would ask Mr. Tanisaka to go one step further and provide his truthful commentary on his agreement, or disagreement, with the statement of facts set forth above.

Husker will hold the vehicle in inventory for Mr. Tanisaka until the end of business Monday. For the sake of all involved, Husker BMW would like nothing more than to have this saga end with Mr. Tanisaka proudly driving his new E90 M3 and showcasing his “Husker BMW” plate frame throughout Southern California.

i think the key here is that payment isn't recieved b/c you are choosing to not recieve it. fly him to the dealership, so he can provide funding validly, and in person.

wrong dude... "the only winners are legal profession".. with respect, they are the only winners, but monetarily. based on principle, Ken will prevail. they are COUNTING on this to find any excuse to prolong and infuriate to either : accumulate further costs and/or to provoke an action.

they will survive it, thats most likely true.... and clearly evident that it their intention, of holding out longer than Ken.

In my opinion, some of what is happening now legally is a direct result of this onslaught. It doesn't affect me either way as I must remain neutral in matters like this. As President of BMW CCA, Missouri Valley Chapter in this region, we have a great relationship , as do our members, with both area dealerships. So, I am not posting to support or bash, just to relay what I know as several staff members of BMW of Lincoln are members, some board members of our chapter. Do I have Fil's (which is short for a very Italian name) phone number on my iphone, yes. Did I get an e-mail response from Larry VanTuyl on this matter when I e-mailed him, yes. Do I know the facts, seen the documents, heard the terroristic phone messages, text messages and other various pranks, and seen the disgust in the eyes of the operators that field these calls, yes. Still I kept quiet...

I have not posted as I really wanted to remain neutral, figuring that the bloggers that are digging up all the data would just flame me as a troll of BMW of Lincoln. Feel free to search all you want, I am simply a BMW CCA member with some insight. If this were happening to Markel BMW, I would be doing the same thing. It isn't an issue of Dealership loyalty. I would ask that you go back and check out the dates of the BBB reports. Fil has only been there for 6-9 months. The Z-06 deal was before he was there. A little more insight. The BMW and Mercedes Benz franchise is a separate sales and service building with its own GSM, its own budget, its own sales staff and mechanics. Those BBB reports were for the GM side, a block, and a world, away. Fil cannot control something when he was not even in the state.
Further, Fil did NOT even know about this situation until after the Internet sales guy tried to squash his screw-up, which is what it was, by some quick footwork that didn't obviously work. Fil found out about it, late on Friday and Ken was called and told by that it would all be straightened out on Monday as it was late, and Easter weekend was coming up. Starting Friday and continuing Sat and Easter Sunday this escalated into, well, I think we know. Know this, as promised, the car was Kens Monday. Were there some interesting requests, and did Fil get huffy on the phone, knowing him, he might have. Remember, bloggers hacked computers and were e-mail blasting him, his staff, his family and were calling him all weekend. TV reporters had called, local newspaper etc. Bloggers had called Fil's Father (who does NOT own the dealership by the way) during Easter Dinner. Also called and harassed were his sisters, brother and other family members. So, if you tell someone that it will be handled on Monday, and you get harassed ALL WEEKEND, I think I would have a few words for the ONLY person he could put a face on that had a role in all this. Given the actions of some bloggers, his actions were pretty tame.

Not even going to comment on the youtube video and the pictures, which I hear are very nice centerpiece of their case at this point. This is, in my opinion, nothing more that mob mentality and has gotten way out of hand. I can share this with you. That place was packed all week with people going in to check out the "infamous" ebay M3. In fact, BMW of Lincoln has sold, and pre-sold, more cars to locals this week thru the foot traffic generated by this so. I would bet they have lost nothing from the stack of new sales order I saw. Publicity, good or bad, is still publicity, get people out to check it out, and this is great FREE publicity. I hope it hits 2,000,000 posts!!!

To be quite honest, both of our area dealerships have great reputations and the CCA members go to whichever dealership is closer. The comments I am getting are, actually, not well received as to the comments and portrayals of the dealership by the bloggers. Most are saying it is just not their experience. Many supportive calls and e-mail were sent as well. For Ken I have this. Yes you will be getting your license place frames, your Husker football Tickets and, as all clients that purchase a new or CPO BMW at BMW of Lincoln, you will receive a 1 year membership to the BMW CCA (or a renewal if you already are a member). It is really too bad that you never heard that this dealership won an award from BMW CCA for the dealership signing up the most members of all dealerships in the nation...thats #1 of 368. Again, just stating facts and not throwing out random conspiracy theories.

From what I saw, BMW NA is not getting involved at this time, but I am told that E-bay and BMW NA will make comments once this is over.....I think you will be interested in that information. One last thing. Fil is Not just the GM, but a part owner of the Dealership, I don't think he will be firing himself anytime soon, certainly over something like this.

I am not a troll, just some lowly 1991 BMW M5 driver who happens to be closer to the situation than I expected. You can google me all you want. You will find pics of my car and articles I have written on our chapter newsletter as well as a link to our Chapter website. Feel free to flame me just the same, call me what you want, I have no angle here, nothing invested. I don't buy my cars from dealerships, only fellow CCA members. I do my own maintenance as I am an aircraft mechanic, and I don't work for BMW of Lincoln. All I can go on is my own experiences with them, which is quite positive, and I hear the same from fellow members.

From here on out, I will only make comments on what I KNOW is fact in efforts to quell this firestorm and set records straight. Hurry up Ken and get this thing paid for at this great price. In the end you are getting a great car.

lol, i HIGHLY doubt that they got any sales.

its very easy to put "sold !" and make multiple copies or print outs and stamp them a few inches thick. (its an old-school tactic to decieve). They very well might be complaints or shows of support for Ken they received !!

yeah, they're getting publicity, but not the good kind for sure. whatever the title he has, he has the top rank in that dealership, so he has got to make it right, regardless of whose fault (internet guy or himself for not checking on everything that goes on in his dealership). i'm sure he gets to approve of putting a vehicle online before its done.

if they wanted to stop the Sh!tstorm, they should accept the payment (its a check, which will probably means it takes a few days to clear, so they shouldn't be crying the very next day when the funds haven't fully been transferred). They have the chance to make things right, and so far, they haven't. its as simple as that.
