Please read before you purchase a BMW

I leased a 2011 e93 m3 in july. vehicle has 5100 miles on it and 5 weeks ago started hearing a clunking sound in the rear end. I brought the car in to service and was told i had a sheared rear end bolt and bent sub frame. They also proceeded to tell me that becuase i have two over revs reg. on my ecu they would not cover the $5000.00 repair becuase it shows i abuse the car. After some fighting back and fourth and three weeks later, they agreed to pay $3900.00 dollars but im still responsible for $1100????? How could two over revs prove i abuse the car and caused this rear end failure? After several phone calls to BMW NA it has fallen on deaf ears. There answer to me was once the regional engineer makes his decision that its.. Thats it? SOME CUSTOMER SERVICE!!!! Finally 5 weeks later the car is ready and at this point im sucking it up and paying the $1100 so i can just get my car back.(ill let amex deal with them after i file a dispute on the charges) My point is before you go dump $80,000.00 on a car , think it out becuase my exp. shows me they dont care. How do you advertise a car on your website on the track than denay a suspension and rear failure due to over revs. I WILL NEVER PURCHASE ANOTHER BMW AGAIN and would hate to see this happen to anyone else..... Im also confused as to if you agree to pick up 3/4 of the repair bill admit its a design flaw not an over rev issue... excuse my spelling and grammer im writing this in extreme anger

Did you miss two shifts?

Where do you think that energy goes?

Good idea with the AMEX; I might have done the same...

Innocent until proven guilty, if its driver error why agree to pick up 3/4 of the repair? Prove to me those two over revs caused this failure and i would have no problem paying the repair bill. Good thing its a lease there will be many more over revs when i return it.. POS

They have shadow data that will show if the car was money-shifted and it is correlated to the mileage. If you were in possession of the car at that mileage, then you are going to have a hard time in court.

An overrev could damage the engine, tranny, diff, etc. I don't see why or how they have to scientifically prove the chain of events. Putting the car in the wrong gear for the speed in question is clearly abuse. Do you disagree with this? If so, on what basis?

I agree that covering a portion of the repair is an odd position, but maybe they are just trying to compromise to retain a customer.

Granted, I do not have my finger on the pulse of the legal system, but I haven't seen anything ruling it unconstitutional - which would likely require the supreme court to get involved, and prevent auto makers from logging the data in question.

I have seen a few cases where the data has been discredited and thrown out as evidence. The former is the more important case IMO, although it is good to see lawyers poking holes in it.

I suppose we will continue to see more and more of these threads as the known weakness between the diff and subframe mounting manifests itself.

The 335 has it HPFP>>the M3 has this..I have been on top of seeing if they are going to release a TSB for this but so far nothing.. I suspect they need to see more documented cases..Time will tell

The funny is everyone I have known with this problem (and its a few) always faced some pushback from the dealer but then ended up having it covered..

The truth of it is if you are going to beat on the car... the stock parts are not going to hold up

I think we are starting to see what happened here.

If this were a "normal" engine, the op would have likely bent a valve. On this car, he managed to break the rear subframe.

Track duty = beating IMO.

This = user error.

just want to praise PACE BMW IN port chester ny for helping me with this situation and standing by a customer. PACE BMW picked up the balance of the repair tab. Got the car back now think ill trade it in for a E 63 AMG...
