In Ontario, Canada the E90 and E92 M3s were taken off of the gas guzzler tax list sometime in the 2011 model year. I bought one in February, 2011 and didn't pay it. The sales associate was quite surprised when he wrote up the bill of sale and it wasn't added by the program the dealership uses. I think that maybe the auto stop feature changed things. E93 didn't make it due to its weight.

Maybe a similar thing happened in the US? Maybe try building an E93 and see if it adds it?
