The 5w40 will be fine. The overfilling will not be.

I suggest you siphon it out of the oil filter housing repeatedly. Or if you drive the car up on some 2x4s, you should be able to get enough clearance to jack it up and drain the oil. If you loosen the drain bolt, it should come out slowly (that way you won't have to drain the whole sump).
