Even the most stupid tech would know that damage wasn't due to a defective part. Yes, you can try, but would look like a douche. Anyway, don't forget a full alignment.

You could make a claim, but if it's slightly more than your deductible, you'd probably be better off paying out of pocket due to the fact the claim would go against your collision. I made a claim several years ago when I was hit parked, Progressive told me it wouldn't go against my record, and make a claim for $800 ($500 deductible). Next cycle my premium iincreased by $500 for that stupid claim. Left them out of principle, but I ended up paying more than before. I'd ask your insurance if you wouldn't get a premium increase, and get it in WRITING. But start with an estimate from a BMW dealership, then decide on a claim; it might have more damage than you think. Good luck.
