Yes, for RPM and top speed, even if you flash back to stock this remains recorded.

Other than that they will not be able to tell. Also remember that this is BMWNA/AG and not the dealership that can see this. My car has seen 8,800 multiple times with zero issues for warranty repairs/maintenance, etc. It has 46,xxx miles now and has had a raised limit for about 40,000 miles.

I would say that half of our clients elect to get the raise and the other half keep those two settings stock.
