No dealership will view this as a defect. Under "Normal" shifting activity, the car will go into 2nd with no problems. Throwing it into 2nd gear as fast as possible is not a good idea. Although I'm guilty of doing it myself from time to time, the M3 isn't an actual race car, despite what people think.
Maybe DCT would be a better option. Nothing shifts faster then a computer assisted transmission.
