Interesting...seems your best recourse if this is non-binding (did you verify withyour attorney there's no holes in the eBay agreement?) is to appeal to eBay to cancel their seller account (they take these things seriously) but I personally would find that a hollow victory at best compared to getting a M3 at a bargain - your call as to whether it's even worth your time.

Partisan to bidder and sellers. They dont have to sell you the car even if you win. Take it up with law makers and ebay policy. You guys can be in denial all you want. Whats morally right and wrong can not be considered. For example. You are not forced to buy the car if you find out it wont smog in California, and the seller is never forced to sell you the vehicle at their own reservation.
Oh and did you go to law school too  ?
