I think the guy only meant they should have planned ahead. If their request was denied and they didn't do anything (like applying for a different visa) till the final order, it is clearly a a bit of negligence. I still dont approve of locking them up with common criminals, they should be afforded bit more comfort, seeing as it may take a while.
