Lease disposition fees not waived

I just received my excess wear and tear statement for my 2007 BMW 335i lease and was surprised to be charged the disposition fee of $350 even though I am now leasing a 2011 M3.
I started the new lease in mid may before heading to Germany for European delivery. I dropped the old car and redelivery of the M3 at my dealership at the begining of August.
After calling BMW Financial, the rep told me that I would have to pay the disposition fee as there is a 2 months limit for waiving the disposition fee. The 2 months are calculated between the start time of the new lease and the turn-in date of the old car, which in my case is 2 months and 2 weeks.
I was really surprised to hear that as it was waived for the previous lease I had with them with a 4 months gap. The only thing that the rep can do is provide a settlement for $150 less.
This does not seem fair for European Delivery customers, and I'm actually pissed about this.
I'll call back tomorrow to talk to a manager and see if I can escalate this.
In the mean time I was wondering if anybody had any similar experience.
