I was originally going to call it a dick move but I re-read that the service was marginal at best. I would have found another server (which may have been hard considering that it was slow) and asked if they could break a $5. Even if he did try to be slick and get the $5, he probably at least deserved the 15% tip. At least it's not at a place you plan on going back to.
