Your 2nd point is simply a line in the software and can be fixed.

On skipping gears, I seem to be able to skip a couple of gears in my SMG3. I am not certain how this happens, whether they engage the clutch or not but with DSG, as I understand it, you must engage the clutch and the sequential gear.

If it is just a line or 2 of code, why hasn't VW fixed it, probably because it reveals compromises else where.
