Car will usually shift down to 2nd. Once you have come to a complete stop it should go into 1st. At least that is what my car does and I drive in S3 or S4 for city driving. I suppose if you are driving in D mode it may simply stay in 2nd like my old 550 would though I can't confirm that. What mode are you driving in?

Sorry, had to re-read your post. yes, if you are doing 40 and quickly try to drop it into 1st, it may prevent you from doing that to protect the engine from over rev-ing
