Can EDC setting be programmed into remote?

I have a 2009 M3 with EDC & Convenient Access. The dealer here in San Francisco is unable to answer my question as to how I can program in the EDC setting so that the car will start up in EDC 'Normal' mode. The way it is now, one key always starts up the car in 'soft' setting while the other will always start it in 'sport'. A small thing, but I have it in 'normal' 90% of the time and always have to switch manually. There should be a way to get it to start up in 'normal', I would think. Anybody know?

The second thing, the machanics at the dealer say it's important to put the key in the slot from time to time so as to communicate information from the cars computer to the key, but also to charge the battery. I was under the impression that the battery was not a rechargable one, but they said that's a mistake in the owners manual, and that indeed the remote contains a rechargable battery in addition to a regular one. Any answers?
